Biography

Dudley is the son of Lewis Hale and Mary Burwell.[1] Dudley married Mary Burroughs. She was the sister of Elizabeth who married Dudley's brother, Francis Hale.[2]

He passed away during the War of 1812 in Norfolk, Virginia.

Research Notes

Dudley Haile, is first found in the 1794 Grayson Co. Virginia Personal Property Tax List. In the 1810 New River Notes of Grayson Co. Virginia Tax list dated 3/27/1810 we find Dudley Hail listed as one Tithable (white male 16 or over) 3 slaves over 12 yrs and 8 horses. He was the only Hail/Hale listed in the 1810 Tax List.[3]

In the 1813 Grayson Co. Va. Person Property Tax list New River Notes we find Dudley with 3 Tithesable men (16 or over) and 2 slaves 16 or over and 6 horses and he owned a grist mill.

Dudley Hail is listed in the Grayson County, Virginia wills 1793-1849 New River Notes. His will was proved Feb 1815 names wife, Nancy and children, Preston, Burris, Lewis, Polly, Franklin, Sally, Jesten, Olive and Elizabeth. No other information is listed in this listing of Wills for the County.

In "Pioneer Settlers of Grayson County" his wife is listed as Mary Burroughs, the above will lists his wife as Nancy. This could be a nickname for Mary or a 2nd marriage.[1]

Pioneer Settlers

Dudley Hale, third son of Lewis Hale, Sr., married Mary Burroughs; he was a soldier, and with five brothers, went to Norfolk, Va., in the war of 1812. Capt. Lewis Hale, his brother, was in charge of the company. Dudley Hale died while they were in Norfolk. His wife died a short time after her husband; his brothers took their children and reared them. There were five sons and five daughters: Preston, Franklin and James moved to Cherokee County, Alabama. Burroughs married Miss Sutherland and settled on Elk Creek; their first son, Alexander, first married a Miss Catron. Second wife, Miss Lucinda Wheeler, of Knob Fork. Second Son, Eli, married Miss Hampton; one daughter married Hackler. Burroughs Hale's second wife was Miss Clara Houk; two daughters by second wife: first daugther married Hawkins; second, Amanda, married Jacob Thomas, of Elk Creek; one son, Jo married Bourne; one daughter married; Cora, first daughter, married Elbert Ring.

Will dated 12an 1815; Will was proven in court in February 1815. Died in Army Camp; Professional soldier in war of 1812.

I Dudley Hale of the County of Grayson and State of Virginia do make this my last Will and Testament, in the manner following to wit my will and desire is that after all debts is paid out of my personal Estate the balance of my personal together with all my real and mixed Estate to remain is possession of my beloved wife Nncy Hail during her life for the use of her and my children and after her death to ______ to them also equally which are as followeth. Preston Hail, Burris Hail, Lewis Hail, Polly Hail, Franklin Hail, Sally Hail, Jestain Hail, Olive Hail, and Elizabeth Hail. 2nd my desire is that an inventory and appraisement to be made without the sale of the property unless it is thought necessary by my executors who I shall hereafter appoint for the purpose of paying some of my debts if there is any the use and possession of the property above mentioned by my wife is intended in lue of her dower. And lastly I do constitute and appoint my beloved wife Nancy Hail Preston Hail and Francis Hail Executrix and Executors of this my will and testament revoking all former Wills and testaments by me made. In testimony whereof I have hereunto set my hand and seal this 12th day of January 1815.

Grayson County Court 1815. This nuncusalive Will of Dudley Hail was proven in Court by Richard Hail Francis Hail and Joshua Stoverman and ordered to be recorded and Nancy Hail Francis Hail and Preston Hail executhasun named came into court and enetered into bond in the penalty of $4000 conditioned as the law directs and qualified according to law.

A deed from Richard Cole and Sarah his wife to Dudley Hail was acknowledged in Court by the said Richard and ordered to be recorded, and a commission for the acknowledgement and pursuant to the said Sarah together with a certificate of the execution thereof was returned to court and ordered to be recorded.
