Note: 9-16-1890 Brief for Circuit Court of Howell County, Missouri, in the City of West Plains Trial against the School District No. 2, Township 23, Range 8 West. Brief drawn up by William Monks, attorney, representing William Harrison Hall. Presiding Judge, John F. Hale. Circuit Court-Clerk, T.B. Carmical. September 16, 1890 W.H. Hall Exparte. 2 2 The petitioner. W.H. Hall respectfully represents that School district No 2 Township 23 range 8 West situated in the County of Howell and state of Missouri was legally organized in the year 1890 under the school laws of the state of Missouri and your petitioner further states that he was a resident of said District No 2 Township 23 Range 8 west in the year 1890 and had been a resident of Said district for a number of years previous to the year 1890 and had the following Children of School age to wit Lewis J. Hall 19 years of age Alice K. Hall 17 years of age Rosa E. Hall 15 years of age Florence F. Hall 11 years of age Lambert J. Hall 9 years of age and Wm (William) Hall 7 years of age. All of whom was entitled to the privelige and benefit of the public school of Said district No 2 Township 23 range 8 West, and at an election in saiddistrict No 2 Township 23 range 8 West there was an election held on the first Tuesday in april 1890 for the election of three directors for Said district and FJ McClain M.H. Woodrell and John H Baily was legally elected Directors and qualified and entered into the discharge of there duties as the directors of District No 2 in Township 23 range 8 west and among other proceedings the following were had and made to wit. The Directors to wit FJ McClain MH Woodrell and John H.Baily employed one AH Whitney to teach a four month school for said District No 2 Township 23 range 8 West for the year 1890 and in pursuance of the contract with said Directors the Said A.H. Whitney Commenced the School on 11th day of August 1890 at the District School House in said District the usual place of teaching the Public school for said District and the Petitioner W.H. Hall on the 11th day of August 1890 sent the following children to School to wit- Lewis J. Hall 19 yr? Alice K Hall Rosa E Hall Florence F. Hall Lambert J. Hall and William Hall And the teacher A.H. Whitney refused to admit them and would not allow them to enter said School represented to petitioner that the directors had given him (the teacher) orders not to admit the children of Petitioner to Said school and ordered the children of Petitioner to return home. Under the school law of the state of Missouri the children of the Petitioner was at the Commencement of the district school and are now entitled to enter said Public school and are entitled to all of the benefits and Privaliges of said Public school said teacher and Directors refused and still refuses to let the children of Petitioner enter said Public school and Petitioner states that he has no specific remedy at law the children of Petitioner has been admitted and had the benefit of all the Public schools that has been taught in said District for the last six years up to the Present school. WH Hall therefore prays the Court for a writ of Mandamus requiring Said School Directors to wit FJ McClain MH Woodrell and John H. Baily to allow the children of the Petitioner to enter said Publiic school or show to Said Court some legal or lawful cause for ejecting or refusing to let the children of the Petitioner enter s Public aid school. And for all damages Petitioner may have sustained from the wrongful acts of said directors FJ McClain MH Woodrell John H Baily And J.P. Kinney Directors and clerk of School district No 2 Township 23 range 8 west. You are hereby notified that on Wednesday the 24 of september 1890 or as soon there after as I can be heard I will apply to John. F. Hale. Judge of the Howell County Circuit Court at chambers in the city of West Plains Missouri at the hour of ten oclock in the forenoon? for a writ of mandamus to issue against you and each of you requiring you to set out the relief amended in the Petition of. W. H. Hall. Sept 19th 1890. WH Hall by his atty Wm Monks. 2 2 The case was sent to the Texas County Missouri Court on a change of venue. From The Texas County Missouri Court Records Book G - Pages 263 - 264. Nov. 24, 1891, Eight Day of November Term. The State of Missouri at the Relation of W. H. Hall, ) ) vs. ) In the Texas County )> Circuit Court, State of F. J. McClain, M. H. Woodrell and John H. Bailey, ) Missouri, November Directors of School District # 2 Twp. 23 North Range ) Term 1891 8 west, Howell County Missouri ). Upon the hearings of this cause upon the alternation writ of Mandamus heretofore issued and the return thereto and the evidence which was submitted to the Court, the Court finds the issues in favor of the relation. It is therefore considered and adjudged by the Court that a peremptory writ of Mandamus issue against the said F. J. McClain, M. H. Woodrell, and John H. Bailey, Directors of School District #2, Twp 23 North, Range 8 West, Howell County Missouri and thier successors in office, now and hereafter, Commanding them to permit and admit the children, to - wit; Louis Hall, Alice K. Hall, Rosa E. Hall, Florence F. Hall, Lambert J. Hall, and William Hall of W. H. Hall, the relation to attend the public school established in said district for the education of white children and this peremptory writ of Mandamus shall be and is declared perpetual so long as said children remain of school age and reside in said district and that the defendants herein pay the cost of this action, and that he have thereof execution. Ordered that Court adjourn till tomorrow Morning at 9 O'clock. C. C. Bland, Judge. 2 These Court affidavits were typed exactly as written, including punctuation, by William Holmes, the gggrandson of Thomas HALL who was born about 1804 in Tennessee and died in Howell County Missouri in 1888. There was a story told by some of the towns people that this was all started over a feud between W. H. HALL and one of the school officals, of course this is unproven, but we do know by the statements mentioned in the court affidavits that these children in question had always attended the public school without any problems untill the incident in question, so it appears that there may have been some truth to the story.
