Claiborne T Smith Jr[1] speculated that Frances was a daughter of a Thomas Harris who d c 1677, probably at Charles City, Virginia: "it would appear that Thomas Harris (died 1677) had at least three children, a son Thomas, a daughter whose given name is unknown who married John Echols, and a daughter Frances who married first John Hardaway and then James Batty."
Smith made this claim based on the entries in the Order Book of Charles City County, Virginia[2], concerning the administration of the estate of Thomas Harris which noted that Thomas Harris had minor children and that administration was granted to a John Hardaway and a John Eckles.
Smith then went on to state: "The issue of Frances HARRIS by her two husbands, John HARDAWAY and James BATTY, can be inferred from the will of her daughter Edith HARDAWAY who married after 1710, as his third wife, Henry TYLER of York County. On his death in 1729 she married Mathew PIERCE of York County who died in 1737. There were no children by either marriage. Her 1739 will, probated in York, devised £25 to be divided among her brother Thomas HARDAWAY, Dorothy HATCHER, Elizabeth LETT and Mary PARSONS. Frances HARRIS and John HARDAWAY also had a daughter Sarah and a son John who do not appear in Edith’s will and may have been dead in 1739. In 1689 James BATTY acknowledged a mare given to his wife’s daughter Sarah HARDAWAY by one Susan HARDAWAY, whose identity is unknown. Sarah probably died young. In 1693 John HARDAWAY, as one of the orphans of John HARDAWAY, being 15, chose his brother-in-law Henry HATCHER of Henrico County as his guardian."
James Batty and Frances F H Batty were witnesses to the will of John Stith in 1690. See profile of John Stith. [NB John Stith had been a guardian of the orphan children of Thomas Harris d 1677].[2]
Frances married James Batty, son of Christopher Batty, after John Hardeman's death. Charles City County Court records include the following entries:
In the Charles City County Court held 4 December 1689, "James Batty records in open court 1 mare (not her increase) for use of Sarah Hardeway, his wife's daughter, this being the gift of Susan Hardeway".[4]
Upon petition of Frances, wife of James Batty, relict of John Hardway, late dec'd, in these words: "That your petitioner's former husband John Hardway, dec'd, did leave an estate indivers goods and chattels in value of 77,000 lbs tobacco & casq., most of which is due to orphans of dec'd, when same shall be lawfully requested, and being desirous that said orphans should have some education according to their estates, humbly prays that the petitioner's present husband James Batty give said orphans such education on such terms as is usual in cases of like nature" Court orders that James Batty do provide that orphans be taught, viz: the boys to read and write and the girls to read, and that the orphans continue and abide with their father in law Batty until just cause appear for their removal. ~ "At a Court Holden at Westover 3rd January 1692"[5]
"James Batty appears for his father Christopher Batty..." in Court held 4 December 1693.[6]
