A Retour of special service was made to David Hepburne as heir of the deceased Patrick Hepburne of Wauchtoune,*his maternal uncle*, in the [feudal] barony of Wauchtoune by a majority verdict of the Assise, held before James Cokburne of Newbigging [near Haddington], Sheriff of Edinburgh in the constabulary of Haddingtoun, Edinburgh, 23rd March, 1473/4. The Assise consisted of: William, Lord Borthwick, Alexander, Lord Glammis, Thomas Kirkpatrik of Closebarne, William Wallace of Craigie, Robert Dalzel of that Ilk, John Ross, John Carmychel of Balmade, Mr William Levinax [Lennox], William Ruthven of that Ilk, Richard Congiltoun of that Ilk [Haddingtonshire], Thomas Wawane, William Levintone, Hugh Montgomery, Thomas Crag of Crag and Thomas Mudie. 5 tags, one seal.[1] An Instrument of Sasine followed on by Precept dated 25 March 1474, in favour of the said David Hepburne of Wauchtoun of the lands and barony of Wauchtoune, 31 Mar. 1474. Witnesses: William Lawder, Rolland Browne, John Crag, Thomas Crag, William Hepburne, Alexander Hepburne, Thomas Hercas, John Hercas, Alexander Gudfalow, Alexander Hamyltoun, James Duns, Thomas Johnsoun, Robert Rawyn and William Mow and John Croser, the King's servants. Notary: Robert Aytoun of St Andrews diocese. Part of seal of James Cockburne of Newbigging, sheriff of Edinburgh in the constabulary of Haddingtoun, appended.
There is in the archives a Notarial Instrument narrating that William Hepburn, as procurator of David Hepburn of Wauchton, compeared of the date hereof, to pay on the High Altar of the church underwritten 50 merks to Patrick Hepburn, Lord Hailes, for redemption of the lands of Over and Nether Hailes impignorated [?] by Sir Patrick Hepburn of Wauchton, knight, to Sir Adam Hepburn of Hailes, father of the said Lord Hailes, and no-one appearing for the latter, the said procurator protested that the impignoration was loosed and that the said David should have full regress in and to the said lands. Done in the Church of the Friars Minor at Haddington, 30th April 1479. Numerous witnesses.[2] This appears to be a wadset.
On 21st September 1498 the King confirmed a charter of David Hepburn of Waughton, signed at Waughton on 5th instant, with the consent of David's wife Christine Sandilands, to his son an heir apparent Kentigern Hepburn, and his spouse Margaret Lauder, the barony of Wauchtoun etc. Witnesses included: William and Henry Hepburn, sons of David, and John Broun of Colstoun (near Haddington).[3]
