Biography

Willis B. Hiatt Was born in 1812 in North Carolina and married 1st. Sarah Brinkley on May 1, 1834 in Davidson, North Carolina[1] where they settled and had 9 children. Sarah died in 1880[2] and in 1886 Willis, then 70, married Catherine (Shoaf) Beck, widow of Solomon Beck. She was 65 at the time of the marriage.[3]

Will of Willis Hyatt I, Willis Hiatt, hereby make and declare this to be my last will and testament, hereby revoking all former wills and testaments made by me. 1st., I hereby direct my executors, herein after named, to pay all my just debts out of the personal property belonging to my estate and after all debts and expenses are paid, I direct that the remainder be equally divided among my children. If any of my children be dead at the time of my death his or her share shall be divided among the deceased child's legal representatives. In this division I include the children of Mary Clodfelter, dec'd, also of John Hiatt, dec'd, and Rufus Hiatt, dec'd, -- the children of each deceased child is to receive the share thier ancestor would have received if alive at my death. 2nd., I will and devise that my land consisting of some one hundred and forty acres, more or less, my home place, be divided into five equal portions or shares so far as value is concerned. I devise out of these five shares, to Eliza J. Lopp, for her lifetime and and its remainder after her death I devise to my lawful heirs, then living. I devise another 15th or share to Cornelia Beck and her heirs forever. Another 1/5th I devise to my grandson Charlie Rufus Hiatt for his lifetime -- after his death I devise the remainder to my lawful heirs then living. Another 1/5th I devise to Alice Johnson, Nettie J. Green, Mary Clodfelter, John Clodfelter and Sallie Lee Clodfelter, the children of Mary Clodfelter, dec'd. Another 1/5th I devise to my children living at my death -- but if any child should then be dead its legal representative I devise shall have his or her share of said 15th interest. I hereby devise that Charlie Rufus Hiatt shall receive the sum of one hundred dollars from the other four devisees above mentioned and in order to secure its payment, I hereby make a charge of twenty five dollars on each of said shares to be a lien on each share in the sum of 25 dollars and if said sum charged to each share be not paid within 12 months from my death to said Charlie Rufus Hiatt, I direct my executors to sell the shares from which the charge may be unpaid and from the proceeds pay said twenty five dollars --remainder of proceeds to go to the one to whom the share was devised. 3rd. I hereby appoint A. M. Hiatt and Joseph A. Hiatt as my executors of this will to carry it out to its full extent and meaning. In witness whereof I, the said Willis Hyatt do hereunto set my hand and seal, this the 25th day of July A. D. 1900. Wit: J. L. Sink, C. F. Lindsay, J. P. McCrary.
