On March 7th 1915, Ernest got into an argument with his brother-in-law, Frank Garner. An altercation ensued and Ernest slit Franks' throat. Ernest was arrested, stood trial, and was convicted of second degree murder. He was sentenced to 30 years in the state prison.
On Sep 12 1918 Edgar Ernest Kime, age 43, registered for the World War I draft while in prison in North Carolina. He declared he was born Sept 11 1875, with his home in Climax, North Carolina. His occupation was recorded as "State Prisoner", employer "State Prison". He declared his nearest relative was Mrs. Martha Kime of Climax. He was recorded as tall, medium build, gray eyes, black hair.

It is not known if Martha legally divorced Ernest, but she did start listing herself as a widow starting with the 1930 census. Perhaps it was just to save face. She is buried next to him in Shiloh Methodist Church Cemetery.
