Order setting day to hear petitioner for Probate of Will } Probate Court, June 9th, 1871
This day came Emily E. SENTELL and filed her petition in writing and under oath, therewith producing and filing in this Court an instrument of writng purporting to be the Last Will and Testament of Lewis HOLT, deceased, and praying for such orders, decrees, and proceedings as may be proper and requisite for the due process and ward? of said will in the court; which said instrument appears to be attested by W. R. FOSTER and M. KIMBROUGH, of this county, and who are alleged to have signed the will as subscribing witnesses thereto. And it appearing to the satisfaction of the Court from said petition that such petitioner is one of the next of kin of said deceased, that Sallie HOLT, who resides in this County, is the widow of said decedent; that said decedent left surviving him his children as follows: to wit: Mrs. Emily E. SENTELL, widow of James J. SENTELL, deceased; Miss Mary HOLT, over twenty one years of age who resides in this county; Mrs. M. M. HALL, wife of E. T. HALL, who resides with her husband in Wilcox County; and his grandchildren, to wit: the children of his son John HOLT, deceased, viz: John Randolph HOLT and Samuel HOLT, minors over the age of fourteen years, and Lewis Powell HOLT, under the age of fourteen years who resides with his grandmother, the said Mrs. Sallie HOLT in this county; Mrs. Sarah K. MOSELY, wife of J.C. [note by CS: should be A. J.] MOSELEY, daughter of Mrs. Ellen WORD [note by CS: should be WORL], the daughter of said testator, who resides with her husband in this county; and the children of Lucy Ann CARLETON, daughter of said testator, to wit: Thomas S. CARLETON, George(?) CARLETON, and Sarah Ann CARLETON, minors over fourteen years of age, and Emma CARLETON, under fourteen years of age, who resides with the stepmother, Mrs. Catherine CARLETON in this county; and Alma T. HOLT, daughter od H. T. HOLT, deceased, the son of said testator, who is a minor under fourteen years of age and resides with her mother Mrs. Carrie HOLT in this County. It is therefore ordered by the Court that the 19th day of July 1871 be set as a day for hearing testimony in proof of said instrument as such will that said W. R. FOSTER and M. KIMBROUGH be subpoenaed to be and appear on said 19th day of July 1971 in and before this Court, to testify and give evidence of and concerning all and any facts touching the validity of said instrument as such will; that said heirs over the age of twenty one years be notified by citation to be personally served on them, and those who are minors, their gaurdian or legal representatives must be notified by citations served on them at least ten days before said 19th day of July 1871.
