Catherine Holtzclaw, daughter of Joseph Holtzclaw and Catherine James, was born about 1783 in Fauquier County, Virginia. She married Joseph A Lawler on May 25, 1801 in Fauquier County, Virginia[1]. Catherine died September 5, 1860 in Fauquier County, Virginia[2]
Joseph A and Catherine (Holtzclaw) Lawler had the following children:
There is some dispute about who Catherine's parents were. Her death certficiate very clearly lists Josiah and Catherine Holtzclaw as the parents. There is only one problem with that, Josiah's wife's name was Susannah not Catherine. That would mean that either Josiah was an error or Catherine was an error when the information was provided for the death certificate. Which is it?
One has to look no further than the marriage record to determine which. I have included the details below. Who were the folks listed in marriage bond. John Lawler was the brother of Joseph Lawler. Eli Holtzclaw was the older brother of Caty Holtzclaw Jr, the bride. Joseph Lawler was the groom. Caty Holtzclaw, mother of Caty Holtzcalw jr gave permission for her daughter to be married to Joseph Lawler. This confirms that Catherine "Caty" Holtzclaw was in fact the daughter of Joseph Holtzclaw and Catherine James. Why didn't her father provide the consent? Joseph Holtzclaw died prior to June 21, 1786, when Caty was just three years old.
Why the error on the death record? Given that her father, Joseph, died when Caty was very young, her mother was left to raise a family of young children. Josiah Holtzcalw was Joseph's brother. It seems clear that Josiah was the relative that helped provide for his brother's children, and likely became a "surogate" father to Caty. It would not have been unreasonable for Joseph Lawler to have mistakenly given Josiah as the father on the death record. By the time he would have met Caty, Joseph was long deceased, and Josiah was probably who he asked for permission to marry Caty
Fauquier County, Virginia Marriage Book 2, page 238
Joseph Lawler, Eli Holtzclaw, and John Lawler were the bondsman, dated May 25, 1801. For the marriage of Joseph Lawler and Caty Holtzclaw. All three men signed.
May the 23rd, 1801
This is to certify that I give leave for license to be issued for a marriage between Joseph Lawler and Caty Holtzclaw Junr this from under my hand. Signed Caty Holtzclaw, witnessed by John Lawler and Eli Holtzclaw
The marriage did not occur before May 25, 1801 which is the date on the bond. It could have occurred shortly afterwards. However, in the absence of the marriage return from the minister, this is the closest date we have.
