Buried at Spier's Ash (Baptist) burial ground, Water Lane, Smarden. His gravestone states that he left two sons and two daughters, Daniel, Joseph, Elizabeth and Eleanor. [1] This agrees with his Will, made 29th June 1799, proved 3rd August 1804, which makes bequests to his sons Daniel and Joseph, his daughters Elizabeth the wife of Daniel Dobel and Eleanor the wife of William Tribe, his granddaughter Elizabeth Austen the child of his late daughter Mary Austen and "the child of my daughter Elizabeth Dobel (who is called William Hosmer)". Benjamin was a farmer, and he tells us that he held his farm on lease from Sir Horatio Mann, Baronet. (Mann inherited large estates from his father but squandered much of his property. He was succeeded by his nephew, James, 5th Earl Cornwallis.) Benjamin's Will was witnessed by John Beslee (or Beasley, Beesely), Thos. Wilmshurst and Jno. Pope. He named as executors his sons and his friend Robert Pyall of Frittenden.
