WILL

JOSEPH HUGHES, son of Stephen Hughes & Elizabeth Childers Hughes In the Name of God Amen I Joseph Hughes of the parish of Southam & County of Cumberland being of perfect and Disposing Mind & memory do make constitute ordain and Appoint This to be my last Testament in manner & form Following (to Wit)
My will and Desire is that my body be decently inter'd and as to my Worldy Goods wich it has Pleas'd God to give me. After my debts are Paid I Give and Dispose of In Maner and form following that is to say.

ITEM: I Give and bequeath to Henry Hobson and his Heirs forever two hundred Acres of Land being Part of the Tract I now live on to begin at the head of a bottom above his spring Near the House that he has bilt & to a run Down to the Creek and then to Continue up the Creek to Pleasants line thence up Pleasants line to a Great Pine and then on Stoners line to include two Hundred Acres. Provi'd he pays my Executors fifty five Pounds.

ITEM: I give and bequeath unto my brother John Hughes two Hundred & seventy five Acres being the land Given him by my father.

ITEM: I give and bequeath unto my loving wife to her and her Heirs forever two hundred & fifty Acres of Land wich was Given to me by my father. I Give to my beloved Wife and Her Heirs forever seven Negros Viz't: Peter, Mary, Sammy, Sue, Major, Little Fann And Little Flitt?. Likewise I Give unto my said wife & to Her heirs forever

All my Persona Estate Except my saddle & Bridle wich I Give unto my Brother John. Also Except three Negros wich I Give unto my Mother Elizabeth Hughes. Viz't: Old Flitt?, Old Fann & Rosamond During her Nathural life and after her decesd to Return to my Brother John Hughes.

I also Give unto my Mother the land Mentioned to her in my fathers Will and After her Decesd to Return to my loving wife Jane Hughes.

ITEM: I Give and bequeath unto my Brother John and His Heirs forever All my Out Lands. Also I Give and bequeath unto my Brother John & his Heirs forer one Negro Garle Named Sarah.
I do constitute ordain & Appoint my wife Jane Hughes, John Fleming & William Hobson Executors to this my last Will & Testament.

In Witness whereof I have hereunto set my Hand & affixed my seal this twenty first Day of November one thousand seven Hundred & fifty five. (signed) Joseph Hughes Signed, sealed, published, Decared and Delivered by the said Joseph to be His last Will & Testament. In presence of: Richard James, Thomas Poindexter, Ann Atkinson.

At a court held for Cumberland County the 28th Day of June 1756. This last Will and Testament of Joseph Hughes dec'd was Proved by Thomas Poindexter and Ann Atkinson two of the Witnesses thereto and by the court ordered to be recorded.

And Jane Hughes executrix, John Fleming, junr and William Hobson executors therein named __ in Court to take upon themselves the Bur__en of the Execution thereof.

Whereupon on the motion of John Woodson guardian to John Hughes Heir at Law of the said dec'd who made oath according to Law. Cerificate was granted him for obtaining Letters of Administration of the D__ estate with the Will annexe'd, during the Minority of the said John Hughes, giving security whereupon he together with Paul Michaux, Gideon Patterson & William Pledge his securities entered into Bond according to Law. Teste: Thompson ___ C.C.C.

John Woodson, guardian for John Hughes, in 1756 made an agreement with Jane Hughes, widow of Joseph Hughes who was the brother of John Hughes who became the "heir at law" to Joseph Hughes who died without children, leaving only a widow and relict.

NOTE: Henry Hobson was the brother of Jane (Hobson) Hughes. Henry's wife was Martha Neville, dtr of James Neville & Lucy Thomas - they were also the parents of Judith Neville wife of John Hughes. Lucy (Thomas) Neville m 2nd Abraham Childers.
