Biography

John Ivey, Sr. was born circa 1676/1677 to Adam Ivey and his wife Elizabeth. Many researchers speculate that Elizabeth's maiden name was Poythress.


In "The Line of Adam Ivey" [1], John Ivey, Sr. is given the designation of of "5," as the fifth son mentioned in the will of his mother, Elizabeth Ivey. Genealogist Robert Baird has generously shared years of research. Here is part of his take on John Ivey, Sr.:

He was living in Prince George County on leased land on 11 November 1719 when he was removed from a 150 acre leasehold.[2]. As a resident of Prince George County he patented 100 acres on 23 March 1716 in what was then Surry County and is now northwestern Sussex County on the south side of Pigeon Creek, about thirty miles northeast of the lands patented by his four brothers.[3] He is not mentioned in any Surry records for several years (the court records are lost after 1718), but he apparently moved onto the land. As a resident of Surry County he patented an adjoining 135 acres on 28 September 1730. [4] Both parcels were on Pigeon Swamp and bordered Miery Meadow Branch (which seems to be what was later called “Ivy Branch”). He purchased 100 acres adjoining these two patents to the north from John Mason on 16 February 1741/2, with John Ivey Jr. and Hugh Ivey, his nephew and neighbor, as witnesses.[5]


Last Will & Testament

[Note: John Ivey’s (spelled "John Ivie" on the document) will is dated 5 January 1750/1 and recorded on 20 March 1753 in Surry County. [6]His death on 21 February 1753, “aged 76 years”, was reported to Rev. William Willie by Hugh Ivey for the Albemarle parish register.]

In the name of God amen I john Ivie of Surry County in the parish of Albemarle being in good health and of perfect Strength of Memory do make Ordain Constitute and appoin this my Last Will and Testament in manner and form following (viz)

first I Give and Bequeath my Soul to Almighty God my Saviour and Redeemer in whom and by the Merits of Jesus Christ I trust and Believe assuredly to be saved and to have full Remission and forgiveness of all my Sins and that my Soul with my Body at the General Resurrection shall rise again with joy and through the Merits of Christ’s death and passion possess and Inherit the Kingdom of Heaven prepaired for his Elect and My Body to be Buried in such place where it shall please my Executor heareafter named.Now for the Settiling my Temporal Estate and such Goods and Chattels as it hath pleased God to Bestow upon me I do Dispose in manner and form following

Item I Devise to my Eldest Son John Ivie to him and his Heirs forever one tract of Land Containing one hundred and thirty five Acres being the plantation he now lives on.

Item I Devise to my loving wife Christian Ivie during her Natural life one hundred and eighty Acres of Land being the Land I now live upon and at her decease I devise it to my Son Thomas Ivie to him and his Heirs forever.

Item I Devise to my loving Daughter Amy Ivie a Gold Ring and a Feather Bed and Furniture and a Small Chest.

Item I devise to my loving Son William Ivie one Gun.

Item I Devise to my loving Wife Christian Ivie a Feather Bed and furniture a large pot and Hooks and a Chest during her Natural life and at her decease to my Son Thomas Ivie, and desire of him for the love of God take care of his Mother.

Item All the Residue and Remainder of my personal Estate I devise to my Son Thomas Ivie and I do appoint Constitute and Ordain my Son Thomas Ivie Executor of this my Last Will and Testament hereby Revoking all former Wills by me heretofore made In Witness whereof I have hereunto set my hand and Affixed my Seal this fifth day of January one thousand Seven hundred and fifty one. John Ivey Signed Sealed Published and Declared in presence of us John Paynter, Thomas Adkins junior, William Wilkinson.

My whole will and desire is that my Estate may not come to an Appraisement.

At a court held for Surry County the 20th day of March 1753 The afore written Last Will and Testament of John Ivie deceased was presented in Court by Thomas Ivie the Executor therein named who made oath thereto according to Law and the same was proved by the oaths of Thomas Adkins Junior and William Wilkinson two of the witnesses thereto and by the Court ordered to be Recorded And on the Motion of the said Executor Certificate is Granted him for obtaining a Probate thereof in due form.
