Jane Johnstone was born in 1659 in Westmoreland County, Virginia and married John Awbrey. They had Francis Awbrey and John Awbrey. Jane died in 1714 in Westmoreland County, Virginia.[1]
On Aug 17th 1702, William was committed to the Westmoreland Prison for suspicion of drowning his man servant ( slave) in the Machodoc River. Jane appealed to the court on his behalf to make available documents for his defence, including deposition and verdict of Jury of Inquest. He was indicted but was acquitted in trial. No further court documents of this matter have been found.
The will of Jane MARTIN, widow, dated 2 Feb. 1676, Copeley Parish, Westmoreland County, Virginia:[4]
"Unto my daughter Jane Johnstone my plantation...If it should please God to take from this life my daughter Jane before she is marryed or comes of age or dieing without issue, the estate to fall into the possession of John Awbrey and James Gaynor. Unto my daughter Elizabeth Pain to the value of fourty shillings...John Awbrey being a liver att my house shall there remain without opposition during the finishing of this crope (sic) or longer as he may find to his conveniencey and not to admitte of any person to dwell upon the plantation without consent from what estate I have willed unto my daughter Jane. (signed) Jane (hF) MARTIN."

DNA Connections
It may be possible to confirm family relationships with Jane by comparing test results with other carriers of her mitochondrial DNA.
However, there are no known mtDNA test-takers in her direct maternal line.
It is likely that these autosomal DNA test-takers will share some percentage of DNA with Jane:
I have read the pages covering August 17 & 18, 1702, in the cited source - page 268 - 279 of 503 - and I see nothing that says they accused each other. The 17th is Jane seeking the right of her husband - who was in jail - to be given documents pertaining to his trail & the 18th is the partial granting of that request. Page 357 (368 of 503) is a record in Williamsburg, 19 April 1704, of William Chandler seeking relief from the Westmoreland County sheriff - "Capt Lewis Markham late Sheriff of ye said County" - in an action brought against him (Oct 1702) in relation to the charge of murder, of which he was acquitted. The Williamsburg court referred the matter to the Westmoreland County court.
I skimmed through the October 1702 minutes in that reference but did not find anything about Markham & Chandler (or Chandelor as it is more often spelled). I also found nothing in the reference to imply that husband and wife accused each other.
Johnstone-618 and Johnstone-683 appear to represent the same person because: same death information and husband. A 1630 birth year guess based on husband's birth year is logical. However, she had to be born after 1655 based on her mother's will. Please merge. Thanks!

I assumed Awbrey in will was a son from a marriage to an Awbrey. Janet Aricui assumed he was the plantation's overseer: Jane JOHNSTONE (the daughter) was underage when her mother died and left the plantation to her. John AWBREY was a adult and an overseer on that plantation. After Jane, the mother, died, Jane JOHNSTONE, the daughter, and John AWBREY married despite the age difference of perhaps 20-odd years. Did she have much of a choice? Jane (the mother's) name MARTIN must have come from her second marriage, after having first married a JOHNSTONE. So she would have been: Jane (maiden name?), 1st marriage to Mr. ______? JOHNSTONE and then 2nd marriage to Mr. ______ ? MARTIN. This was not on the internet, it was from will books of Westmoreland Co., VA., although still not originals.
The merge of unnamed father Awbrey and John Awbrey b 1623 Wales (now Awbrey-38) was good. But, based on the widow Jane Martin's will (see previous post, found on Janet Aricui's site, her page for Jane Johnstone), it may be that John Awbrey b 1623 m _a_ Jane b 1629 (not THIS Jane, tho) and they had sons Francis and John. However, there were about three generations of brothers John & Francis, so it may be that Jane Johnstone was the mom but John b 1623 wasn't the dad. I need to do more research on my 6x-gr-grandfather Francis & figure out why I have his birth year as abt 1661 (I SO regret not slowing down enough to add source information for every detail when I first found WikiTree!)

Johnstone-683 and Johnstone-618 are not ready to be merged because: they're probably the same person, born 1659, which would mean they're not the Jane who was born 1629, England, who married the John Awbrey born 1623, Wales, who were parents of John & Francis (b about 1661/m Frances Tanner) .
update - I just added a "See also" source on Johnstone-683... I think 1629 is probably the better choice (which also doesn't disqualify her from being the mom of Francis Awbrey-35, born about 1661).
