Petition of George Blair & wife Jane vs. Saml Johnston, Admin of the Estate of Gov. Gabriel Johnston
(abstract)
In May of 1751, Gov. Gabriel Johnston Esq. made his Will and left a legacy to the daughters of his brother, "two negroes at the day of their marriage" and Gabriel Johnston's wife, Frances, was made Executrix of the Will. Frances afterwards married John Rutherford, and they together were possessed of a large estate fo Gabriel Johnston. The plaintiff, Alexander Stewart, was lawfully married to Penelope, one of the daughters of Samuel Johnston deceased who was brother to Gabriel Johnston, on 23 Nov 1758. The Executors had failed to provide the negroes at the marriage, or any time after, and since then, Frances Johnston Rutherford had died without any compensation or consideration for the legacy. Administration of the Gabriel Johnston Estate was then granted to Samuel Johnston, Jr., nephew of Gabriel Johnston. The petitioner, as Administrator for his wife, further asked for compensation from the estate for the lost work that the negroes would have provided had they been granted at the marriage. Samuel Johnston, as the Administrator and Defendant, confirmed the truth of the petitioners statements and further testified that no negroes had ever come into his possession, but that he felt there was enough capital on hand to make a restitution. The Court granted One Hundred Sixty Pounds, being the value of two negroes, along with interest in the amount of one hundred & nine pounds, twelve shillings for a total of two hundred sixty nine pounds, twelve shillings.
