The surname Justice is derived from the office of justice or judge and may have been bestowed on the first bearer of the name for especially long or meritorious service in that capacity. The name is occasionally found in early English and American records in the spellings Justis, Justiss, and Justus as well as Justice. The last is the form most frequently encountered.

Families bearing this name resided at early dates in the English counties of Salop (Shropshire), Derby, Norfolk, Oxford, Buckingham, and York, and in the city of London. They and their progeny were for the most part of the landed gentry and the yeomanry of Great Britain.The name also appears infrequently in the early French records, but it seems that the Americans of this name are of English stock. Their ancestors probably first entered England with William the Conqueror.One of the first individuals of the name mentioned in English records is Eva La Justice, who lived in County Norfolk during the middle of the 13th century. Nothing further is known concerning her, nor of John le Justice of County Oxford, Henry Justice of County Buckingham, and Robert le Justice of County York, all of whom lived about the same period. The year of 1379 found three persons of this name residing in County York: Honnana Justys, Johannes Justis, and Robertus Justys. The list of scholars attending Oxford University in 1571 includes the name of a John Justice otherwise unidentified.

(From LDS records in York County, England, alone there were Parris Justus, christened in December 1722, Saint Peter's Cathedral, son of John Justus. Also, a John Justis, son of John Justis, christened 24 March 1732, Sheffield; James Justis, son of John Justis, christened 20 Jan 1735. John Justis married Elizabeth Browne on 24 July 1759, Sheffield, Saint Peter's. The Justice name was not unusual in England.)
