Biography

John Justice, Sr. AKA Justis, Justus

Caution: Two John Justices

This profile represents the John Justice of Massachusetts who married Mary Moore, then to Halifax County, Virginia, and his sons removed to eastern (Floyd Co.) Kentucky.

The other John Justice born at Charles City Co., VA,, married Mary Hogue, and is sometimes believed (without evidence?) to have been the John Justice whose sons removed to Floyd Co., Kentucky.

Origin

John's origin has traditionally thought (incorrectly?) to have been Virginia, as the grandson of William Justice (1625-1664) and Mary Frame, of Charles City County, Virginia and the son of John Justice, Sr and Mary Wade. The problem with this theory is the lack of documentation connecting the Justice family of Charles City County, Virginia with the Justices of Halifax County, Virginia.

Recent research by Thomas Justice has found that John Justice, Sr. may have been born at Scituate (later Hanover), Plymouth County, Massachusetts,[1] although his actual birth record has not been found. Possibly he was actually born in England, as it seems he was a member of the Anglican Church (see Congregational Church of Halifax ... below).

His marriage to Mary Moore was found in the Vital Records of Scituate, Massachusetts,[2] and the children's births in the Vital Records of Halifax, Massachusetts.[3]

Birth date 1695 is a guess, based on his stated age of 59 in land records at Halifax County, Virginia in Halifax County, Virginia in 1754.

Marriage and Children

John (as Jo[h]n Justis) married 1 August 1728 in Scituate, Plymouth County, Massachusetts, to Mary Moore (as Mary Mor).[1][2] The marriage record included their birth places, "[Justis of Hanover and Mary Moor C.R.2]" C.R.2 stood for Second Church of Scituate, now the First Unitarian Church of Norwell.[2] Apparently, the church record stated Mary was born in Ireland.[1]

Congregational Church of Halifax, Massachusetts

Soon after their marriage, John and Mary removed to the future Halifax area (incorporated in 1739), which was then parts of Middleborough, Pembroke, and Plympton, Massachusetts.[1] Nevertheless, earlier records are often filed under the name, Halifax.

Apparently, John Justice was not a full member of the Halifax church, because he was "not of their church 'format.'"[4] On June 21, 1739,
Upon the request of Jno. Justice a member of the Church of England, the church voted to receive him to occasional communion at the Lord's table.[5]
It seems that John argued there were no Anglican churches in the area.[4] His children were baptized at the Congregational Church at Halifax.[4]

Massachusetts, Virginia, and Kentucky

John and Mary lived at Halifax, Massachusetts until about 1745, when they removed to an unknown place. They first appeared at Halifax County, Virginia in 1754, when John Justice, age 59, registered some 1200 acres (in three 400 acre blocks).[1] One of these blocks adjoined both the lands of George Green and John Moore.[1] John married Mary Moore, and his daughter married George Green.

John's sons all eventually removed to eastern Kentucky.[1]

Death and Legacy

John died between 11 March 1765 (will written) and 17 July 1766 (will recorded) at Halifax County, Virginia.[1] John died at Antrim Parish, Halifax County, Virginia.[1]

John and Mary Justice were the ancestors of the east Kentucky Justices.[1]

Last Will & Testament

The will of John Justice, Sr. was written on March 11, 1765, and was recorded on 17 July 1766 in Halifax County Will Book 0, Page 206.

Halifax County in the Province of Virginia, March 11, 1765. In the name of God the Last Will of John Justice Senr. being in health and of sound memory thanks be to God almighty and calling to remembrance the onsartin astate of this transatory life and that all flesh must yield to dayth I do declare this to be my last will and testament in form and manner revoking and annulling by these presents all and every testement and testements and will & wills heretofore by me made & declared either by word or in writing and this is to be taken by these presents that I John Justice Senior give and bequavath unto my beloved wife Mary all my goods and chattels and all movables that I am in possession of on Harpin Creek as long as she remains my widow likewise unto my son Ezra Justice three hundred acres of land and a mill on it which is the home plas. Likewise to my son William Justice one hundred acres of land lying on Pigg River likewise unto my son John Justice five shillings unto my son Simeon Justice five shilligs and unto my son Thomas Justice five shillings and unto my daughter Mary wife of George Green five shillings likewise to my daughter Alice wife of Thomas Watson five shillings.</br> Signed sealed and delivered in the presence of William Wilchen, William (his X) Adkinson, John Wilchen[1]

Justice DNA

John Justice (c1696 England - 1766 Halifax Co VA) m. Mary Moore c1728 Genetic Family 05 has Scandinavian DNA and the oldest known common ancestor appears to have come from Sweden and settled in early Delaware and New Jersey (shortly after the area was the New Sweden colony). Although many amateur genealogists confuse this family with the other genetic families, data from this project definitively proves that this genetic family is unrelated (within a genealogical time frame).

The John Justice Jr, listed above, was the son of John Justice Sr and grandson of William Justice and Mary Freame Justice. He was born in Charles City County, British Colonial America, now Virginia. John Sr is documented in Charles City County Orders 1687-1695 p, 587, 5 August 1695 as serving on Jury Duty. John Sr. died ca.1715 and Mary his wife married Mr. Wade. John Jr continued to live on his father's farm. The next record of John Jr. is 1737-1751 Order Book. A wife Mary is mentioned. Charles City County Orders 1737-1751 p. 101, September Court 1739, Mary, mother of John Jr. relinquishes her right of Dower to Land in the said Deed. About 1740 John Jr, Mary and their children leave and move westward. Augusta County Order Book 3, p 186 29 August 1751 shows John has built a water gristmill for a .Mr. Wilson. In 1756 he returns to Halifax County, British Colonial America now Virginia. The Will Book 0 p. 206 17 July 1766 he mentions all his children. Ezra, John , William, Simeon, Thomas, Mary, wife of George Green and Alice, wife of Thomas Watson. John Jr was never in Halifax County, Massachusetts. His wife Mary is probably Mary Moore born in Halifax County, British Colonial America, now Virginia who married a John Justice. Hello, I think I may be a descendant of John and Mary Justice, but I am not sure. I recently started a family tree on Ancestry on the two week trial. I tried to find my way up the chain, but it is hard to be certain that I was choosing the correct records. I know that my family has a justice reunion every year in Aurora Missouri, and I tried to go off of what I remembered hearing from others who have done the research, but there is so much I don't remember. I know that several members of my family did dna testing years ago before ancestry dna was a thing. However I don't know much more than that. Could someone please help me figure out if this really is my ancestor. Thanks.

Justice-1382 and Justice-56 appear to represent the same person because: These appear to be duplicates. They have the same dates and the same daughter
