Keir was called upon to show cause why A.L.P. 360 s.w., should not be forfeited on the grounds that the land was purchased originally as trustee for Eugenie Zavalshian, an un-naturalised British subject; that he executed a transfer in favor of V. Vittee within the first two years; that he failed to effect improvements within the first two years; failed to hold the land for his own exclusive use and benefit; held it as trustee for. E. Zavalishian and V. Vittee contrary to the Land Act, and that such lease was held by fraud upon the Land Act. The Commissioner found in favor of the Crown, and that the lease was liable to forfeiture.
