Marriage Bond Date: June 3, 1815 - Rowan County, NC. Bondsman: Christopher Keller; Witness: R. Powell (Note: Some have suggested that Arminta "Minty" Kelley's maiden name might be Keller instead of Kelley because the bondsman's name - "Christopher Keller".)

Samuel Roberts' Will: D:90. Samuel Roberts. 17 April 1799. no prb. date. Wife Sary. Nephew: Harmon Latham. Niece: Araminda Kelly (under 21). Exrs.: wife Sary, nephew Harman Latham. Wit.: Elijah Renshaw, Sarah Renshaw. "Beloved wife Sary a free and full possession of all my estate, real and personal, during her life or widowhood." The will further contained an unusual provision that Samuel's nephew, Harmon Latham, was "to be a co-partner with my wife and at the death or re-marriage of my wife the whole to descend to him," except for certain personal property left to his niece, Arminta Kelly. The will left to Arminta a feather bed and furniture to be delivered to her on her marriage day or upon her reaching 21.


Loose Estate Papers Roll 42 Estate of Samuel McGuire--1824 Pursuant to court order commisioners laid off the dower of Minta McGuire, wd of Samuel McGuire, Deceased in the lands he died seized and possessed of described by metes and bounds as 33 acres. August Term 1828.. Rowan County August Term 1828 Ordered by the Court that the Sheriff summon a jury of good and lawful men to lay off by metes and bounds the dower of Minty McGuire in the lands whereof her husband Samuel McGuire died seized and possessed in Rowan County. This record indicates that Samuel McGuire had died by August, 1828 and that a dower interest in his land was laid off to his widow, Minty McGuire.


Davie Co., NC Deed Book 1, Page 471--Deed dated 5 December 1836. I, Minty McGuire am held and firmly bound unto Andrew Setzer in the sum of $400 which payment will and truly be made and done I bind myself . The condition of the above obligation is such that whereas the said Minty McGuire has this day sold unto Andrew Setzer her dower right in the land formerly owned by her husband Samuel McGuire dec the boundaries of which will more fully appear by reference to the report of the jury appointed by the county court to lay off said dower which instrument is filed in the clerks office the said Setzer has agreed to give the sum of $150 for the same and and given his note for that amt. This is a bond for title rather than a deed.


Arminta's Uncle, Samuel Roberts: Our Samuel Roberts was identified as a resident of Surry County on 14 August 1797 when he purchased from Samuel Doyel and his wife, Martha, a 104-acre tract of land in Rowan County joining Jacob Keller and the old road. It is this 104-acre tract of land that Samuel Roberts bequeathed to his widow, Sarah, and his nephew, Harmon Latham, in his 1799 will.

Notes from Tony Collier (AECOLLIER@aol.com ) Dated September 27, 2007 My third great grandfather, Harmon Latham, was born between 1775 and 1778, but I have not determined where he was born. I have not yet identified his father, but I have tentatively determined that his mother's maiden name was Roberts. This identification is based on provisions of the will of Samuel Roberts, dated 19 April 1799 and probated in Rowan County. In this will Samuel Roberts bequeathed to his "beloved wife Sary a free and full possession of all my estate, real and personal, during her life or widowhood." The will further contained an unusual provision that Samuel's nephew, Harmon Latham, was "to be a co-partner with my wife and at the death or re-marriage of my wife the whole to descend to him," except for certain personal property left to his niece, Arminta Kelly. The will further provided that Samuel's wife and Harmon Latham were to be co-executors of the will. I have no record of the date of probate of this will. Samuel Roberts The provisions of Samuel Roberts' will identifying Harmon Latham as his nephew seem to indicate that Harmon Latham's mother was Samuel Roberts' sister. I have found information about a number of individuals named Roberts in Rowan and Surry Counties in the late 1700's, but I have not yet made any further identification of Harmon's ancestors. There were at least two individuals named Samuel Roberts in the Rowan County/Surry County area. Our Samuel Roberts was identified as a resident of Surry County on 14 August 1797 when he purchased from Samuel Doyel and his wife, Martha, a 104-acre tract of land in Rowan County joining Jacob Keller and the old road. Arminta Kelly It is not clear just what relationship there may have been between Harmon Latham and Arminta Kelly, the other legatee in Samuel Roberts' will. Perhaps they were first cousins or they may even have been siblings, with their mother having been married twice. The will left to Arminta a feather bed and furniture to be delivered to her on her marriage day or upon her reaching 21. Later census records indicate that Arminta was born in Maryland about 1784. It is possible that Arminta was the female in the 16-26 age bracket in the 1810 census listing for Sally Roberts. Rowan County records reflect the marriage of Minty Kelly to Samuel McGuire, son of James McGuire, on 3 June 1815. The bondsman was Christopher Keller. The name of the bondsman suggests the possibility that Minty's name was Keller rather than Kelly. As indicated above the land acquired by Samuel Roberts adjoined land of Jacob Keller. Samuel McGuire was listed in the 1815 Rowan County tax list paying for one poll but with no land. Samuel McGuire died about 1830. In the Davie County Public Library I found the following record in the McGuire family folder which purports to list the children of Samuel McGuire and Minty Kelly (or Keller) as follows: 1. Richard--known son. 2. Cornelia b. 1823 m. Daniel H. Brown - 1851 3. Timothy m. Eliza Roberts. Timothy's father left him nothing. Father's estate in hands of Lemuel Bingham. Timothy had 2 boys and 2 girls. Also not positive Timothy is Sam's son. 4. Elvira m. I. Ha.. (or John Hall) 1840. 5. Mary or Maria ? (maybe married a Nail) 1851 6. George ? This listing of children is followed with a statement that Minty McGuire sold her land on Bear Creek to Andrew Setzer. In the 1830 Rowan County census the household of Minty McGuire was listed. Minty was the female in the 40-50 age bracket and there were five children, two in the 10-15 age bracket and three in the 10-15 age bracket. Minta Maguire was listed in the 1840 Davie County census in the 60-70 age bracket with three other females, two in the 15-20 age bracket and one in the 20-30 age bracket. Minty McGuire was listed in the 1850 Davie County census at the age of 66, birthplace Maryland. Also included in her household were Mary McGuire, age 23, and Cornelia McGuire, age 21. Minty McGuire was listed as the owner of one lot in the Davie County tax lists for the years 1858 through 1860. I have found no further information about Minty or her children.
