Biography

Joseph Lane b. abt 1700, m. Patience McKinnie bef 1725. They had 6 sons: John, Barnabus, James, Joseph, Jesse and Joel. Only the birth dates of Jesse: 3 Jul 1733 and Joel: 1739 are documented. But it is very likely that his oldest son John was b. about 1724."

Joseph Lane Jr, son of Joseph Lane Sr and Julian, probably Jarrell, was b. in Surry Co, VA. The following is regarding his life.

Colonel Joel Lane was a statesman "to the manner born," and during the War for Independence was at onetime its presiding justice.* Throughout the entire conflict with Great Britain he served with fidelity in many important civil stations. He not only represented his county as senator for fourteen years, but his name appears in "Colonial Records" as Lieutenant Colonel, 1772. His dwelling still stands, a landmark of the Revolution, and was considered at the time a rare specimen of architectural elegance. He was a member of the first Provisional Congress which met at Hillsorough twenty-first of August, 1775, in defiance of the proclamation of Governor Martin, issued twelve days it, advance, forbidding such an assemblage.

Joseph Lane of 1710 married Patience McKinne, daughter of a wealthy Scotch immigrant who owned vast quantities of land in what was then known as the Caledonian regions. Their sons were Joel, Jesse and Joseph Lane. They moved from the vicinity of Halifax on the Roanoke to a comparative wilderness in Johnson County where Raleigh, the capital of North Carolina, now stands.

On 4 April 1720 Joseph Jr received 600 ac in Chowan Prec. in Urahaw Woods, North Carolina, joining property of father Jos. Sr, Lazarus Whitehead and east side of Quarter Swamp.[1] Based on 1700 as a birth date, he would have been 20 years old.

In 1721 Jos Jr is taxed in Chowan. NC Taxpayers, 1679-1790 where it lists Joseph Lane, (Jr) 500 ac, Chowan County, 1721[2] (2)

In 1722 the county was formed as Bertie Precinct from the part of Chowan Precinct of Albemarle County lying west of the Chowan River. Urhaw Woods and Quarter Swamp are west of the Chowan River.

In Bertie County, Joseph Lane Junior of 1700 married Patience McKinne, daughter of a wealthy Scotch immigrant who owned vast quantities of land in what was then known as the Caledonian regions. He was probably married to Patience McKinnie by 1725 because he is signing deeds with his wife by this date. (He had to be at least 21 to sell land.)

On 9 May 1725 Joseph Lane sold to Robert House 50 ac for 2 pds E. side of Hunting Quarter Swamp, along the line between Joseph Lane, Sr and Joseph Lane, Jr; This is signed by Joseph Lane who mentions his wife Patience Lane.[3]

Between 1726 and 1763, Joseph Lane Jr either sold or bought more than 15 pieces of property in the Bertie/Edgecombe/Halifax area.

Joseph Jr and wife Patience sold to John Hardy 200 acres in Edgecombe for 200 pounds, except for 2 acres sold to his Majesty's Justices. This land had been conveyed to Joseph Lane by Benjamin Hill 1 April 1743.[4] The sale of these 2 acres was confirmed 20 Aug 1747. Joseph Lane for 10 shillings conveyed the 2 acres for a court house to the justices of Edgecombe County. Wits: John Lane, Barnabas Lane, Nathan Cooper.[5][6]

19 Feb 1755 Joseph Lane deeded to a gift of a slave to his grandchildren, daughters of son John Lane and daughter-in-law Mary.[7]

They married before 1725 based on Bertie Deed BK B, 145.

Bertie Precinct was formed in 1722. Mary Best Bell has transcribed the Bertie County Deed Books A-H 1720-1757. NC Archives have the originals Many of the deeds recorded in Book I in the office of the Register of Deeds at Halifax, bearing dates between 1732 and 1741, locate the lands either in Bertie or Edgecombe precinct, as the views of the draughtsman dictated, and in Albemarle County when the county was mentioned.

Will

The following conveyances appear in the Register of Deeds Office at Edenton, NC …." Joseph LANE was born about 1700 in Virginia.1 He died before Feb 1777 in Halifax County, North Carolina.1 Left will dated 29 Nov 1773 and probated in Feb 1777. Joel Lane executor for his father.[8]

In the name of God Amen. I Joseph Lane of the county of Halifax in the province of North Carolina being sick and weak of body, but of sound and perfectr mind and memory calling to mind the certainity of death and the undertainy of the times therreof, do make and ordain this my last will and Testament in manner and form following. Forever one Negro Boy Ned about seventeen years, one Negro man named Dick aged about fifty five years. Item I give and bequeath unto my son Jesse Lane and his heirs forever two negroes to wit:a Negro man named Joe and a Negro wench named Mariah & my will and desireis that he may not carry the said negroes out of the province. Item I give and bequeath unto my grandson Henry Lane one Negro Boy named Hercules aged about ten years. Item Igive and bequeath unto my son Joel Lane and his heirs forever all the rest and remainder of my estate of what nature or kind soever real and personal not hereinbefore bequeathout of which he is to pay and discharge all my just debts and funeral expenses and lastly I do appoint my said son Joel Lane whole and sole executor of this my last will and Testament hery revoking and disannulling all former or other will or wills by me made ratifying and confirming this, and only this, to be my last will and Testament, in wittness whereof I have hereunto set my hand and seal this twenty ninthday of November 1773, will and Testament in presence of Thomas Howell/Henry Holt & Proved by Thomas Howell a witness thereunto in one form of Law & on Not. Ordered to be recorded. II Page 43.

The Joel Lane House museum in Raleigh NC describes Joseph: Joseph Lane. (c.1705- by 1777) May have served as Colonel in the militia. Lived in Halifax County (formed out of Edgecombe County). Married Patience McKennie (d. c. 1755) in or before 1725 (not 1730 as previously thought). His will, written in 1773, was probated in 1777. The couple had six sons.

Please work with me. If you look at my work, this will be less confusing.

Regarding animal marks: http://www.ncgenweb.us/franklin/brands/brands.html  there were registrations at different time periods in Edgecombe County for this Lane family   In 1732 Joseph Lane (probably age 32), John Lane, son of Joseph Lane (probably age 34) and Benjamin Lane (probably age 26). 

In 1736 Thomas (probably age 29). I believe that these 4 men: Joseph, John, Benjamin and Thomas are all brothers.  (They came to this area in about 1720.)

In 1738, John Lane, son of Joseph Lane Jr (probably age 14).  This is the second generation of Lanes where John, son of Joesph and Patience has been given animals to care for.  In two years time he is given land by his father.

Eric, This is the correct Profile (Lane-11307) for John Lane (1698-1777), son of Joseph Lane and Julian. They are not duplicates. The other John Lane, son of Joseph Lane and Patience McKinnie wasn't born until about 1724. Lane-2468 contains information for both men.(Very confusing.) Let me list the activities of the John Lane, son of Joseph and Patience: 1738 he registered his animal mark; 1740 he was given 338 ac of land by his father Joseph; 1755 his wife and children: Ann, Mary, Patience received a slave from his father Joseph and McKinnie land from his mother Patience. The same year he sold 300 ac of McKinnie land to his father; 1760 John Lane living in South Carolina wrote a petition regarding the land originally owned by his grandfather Barnaby McKinnie;1764 John Lane of Craven county, SC appointed his brother James as his attorney to sell 650 ac of NC land and Joel Lane, another brother bought that land. (I have documents for all of these actions.) What ever else is in that profile Lane-2468 does NOT apply to him.

It is correct that the john son of Joseph and Patience registered a mark (or more likely had one registered for him), but you put it also on this John

Lane-11171 and Lane-1660 do not represent the same person because: John is NOT Joseph. They were born 24 years apart. They did have the same name for a father, but these fathers were born again 35 years apart. Please review your thinking!

Might the profile managers rewrite the first paragraph of THIS man's biography, to be about him; rather than his father of same name? Sentences using "he" ought to be describing THIS man, right? Else it is confusing to follow your narrative and research notes about "his" life, when it's not clear if you're writing (here on this page) about father or son.

I agree that John Lane (1726-1771) had only 3 daughters in 1755, but he had at least one son Osborn, born in about 1757 in South Carolina. There are 3 documents: a petition, and two land deeds that give his address as Craven County, SC in 1760 and 1764. As he sold his NC property, he stayed in SC.

The property of his son Osborn is found along the Pee Dee River in Marion County, SC. I expect the father had property there as well. ( One reference shows that "Mr. Laine" was adj. to William Hull along the Pee Dee River in 1770.) Please review the SC Counties and Parishes of 1760. They show the area of Craven County and the various parishes near the Pee Dee River. The map is found at John Lane-11171.

Chowan County records are different. These are not free but I can get the images for you. For John "L" Lane and Mary "M" Lane records start 1719 through to mid 1720s. Then they go missing from NC records. It isn't till mid 1740s that John Lane and his wife Mary Unknown turn up in Edgecombe and Halifax Counties. Note they dont have middle names.

Eric, I have reviewed most of the Lane family records of Bertie, Edgecombe and Halifax counties of NC. (They are all available at Family Search.) Whenever John Lane and his brothers: Joseph Lane, Benjamin Lane and Thomas Lane were grantors or selling property, their signature includes a middle mark...sometimes it looks like an initial and sometimes a modified initial. If you need to review this work, I can give you exact image pages from Family Search. Please review. Thank you for your help.

The reason that you don't find John Lane with middle mark is that John Lane (1698-1777) bought 150 ac of property from Barnaby Mckinnie 12 Aug 1724, so described as near Reedy branch, South side of Conocarra Swamp. it is likely that he stayed there the rest of his life. (See Family Search, Bertie DB A, p. 267 (image 274/470)).

Eric, I am very upset with your above remarks regarding the middle mark in the names of Joseph L lane and Mary M Lane. In the past week I reviewed many of the land documents of this family, from 1723 to 1755. In most of the grantor documents where a Lane male (sometimes his wife is listed) are selling property, you will find a middle mark. There are 6 similar marks in the Bertie Deeds, 2 in the Edgecombe Deeds and 10 in the Halifax deeds. All of these marks are found in the same generation: John Lane, Joseph Lane, Thomas Lane, Benjamin Lane, all sons of Joseph Lane and Julian. Sometimes it looks like a letter and sometimes it looks like a modified letter. (Most cases it is not an X.)

The above remark suggests something different. Please review your ideas. I can give all of these references if you like. Thanks for your help.
