1795 May 6 - Albemarle County Order Book 1794-1795, p. 370. John Melton lessee of, Sarah Leake, Mary Leake, Mary Hart, Samuel L. Hart, & Elizabeth M. Hart by Andrew Hart their guardian vs. Benjamin Wooddy & William Melton.[1]

The following indenture was entered in 1800 naming the heirs of Samuel and Elizabeth Leake, deceased, selling the lands he'd had owned in Albemarle County by his executor Mask Leake, daughter Mary Leake, and Andrew Hart, widower of daughter Elizabeth (Leake) Hart, to James and Sarah Robertson, formerly Sarah Leake. This record names the two surviving children of Elizabeth (Leake) Hart, excluding the daughter Elizabeth M. Hart named in the 1795 suit brought by Andrew Hart against the Melton's (who had leased their land).
This Indenture made this twenty ninth day of January in the year of our Lord one thousand eight hundred between Mask Leake Executor of the last Will and testament of Samuel Leake, Dec'd, Mary Leake and Andrew Hart guardian of Mary Hart and Samuel Leake Hart of the one part and James Robertson of the other part Witnesseth that the aforesaid Mask Leake Executor as aforesaid, Mary Leake & Andrew Hart Guardian as aforesaid, have proceeded to sell all that tract or parcel of Land lying the County of Albemarle whereof Samuel Leake Died seized by virtue of a clause in the said last Will and Testament of the said Samuel Leake, Dec'd. And by these presents the said Mask Leake Executor as aforesaid, Mary Leak and Andrew Hart Guardian as aforesaid, for and in consideration of the sum three hundred and forty-six pounds ten shillings, two thirds whereof amounting to the sum of two hundred and thirty one pounds to them in hand paid the receipt whereof is hereby acknowledged for the use of Mary Leake one of the legatees of the said Samuel Leake, dec'd, and Mary Hart and Samuel Leake Hart, the surviving children of Elizabeth Hart, formerly Elizabeth Leake, another of the legatees of the said Samuel Leake, Dec'd, who intermarried with the aforesaid Andrew Hart , the remaining one third of the aforesaid three hundred and forty six pounds ten shillings amounting to the sum of one hundred and fifteen pounds ten shillings the said James Robertson keeps for the use of himself and his wife Sarah Robertson, formerly Sarah Leake, another of the legatees of the said Samuel Leake, Dec'd, do bargain and sell the aforesaid Tract or parcel of Land where of Samuel Leake died seized lying and being in the County of Albemarle...

Oops, missed one. Apparently Andrew & Elizabeth Leake had 3 children. He was guardian to Mary Hart, Samuel L. Hart & Elizabeth M. Hart in May of 1795, in addition to his two sister-in-laws Sarah & Mary Leake.https://www.familysearch.org/ark:/61903/3:1:3Q9M-CSLZ-5LLD?i=516&cat=275687. The daughter Elizabeth must have passed prior to the sale of Samuel Leake's land in Jan 1800 when she was not included in this indenture...https://www.familysearch.org/ark:/61903/3:1:3Q9M-CS4H-4SSP-M?i=236&cat=283051

Elizabeth's children Mary Hart & Samuel Leake Hart were named in a deed I've just transcribed onto the profile of Rev. Samuel Leake. The son Samuel Leake Hart was probably born about 1790 with parents marrying in Dec 1786 and Mary Hart being first born in 1787. Due to there only being two children born to Andrew & Elizabeth, by 1799 (mother's admin) and certainly by Jan 1800, it is probable Elizabeth had been gone for quite a while. Andrew was named as guardian to the children so there may be existing documentation of when that guardianship was obtained to help pin-point her death.
