(1940). DIVORCE GRANTED. Reserved judgment was delivered by Mr. Justice Dwyer, in the Supreme Court yesterday afternoon, on an action in which Charles Edgar Sharpe, petitioning on the ground of desertion, sought divorce from Edith Winifred Sharpe, who cross-petitioned on the ground of adultery. Sharpe admitted adultery, but Invoked section 77 of the Supreme Court Act, which states that the Court shall not be bound to pronounce a decree on the adultery ground when the party relying on it has deserted the other party. The Judge found that in this instance the party "Immediately responsible" for the separation was the wife, that her husband's adultery had been well known to her, and that she had become averse to sexual intercourse. His Honour, holding that section 77 had particular application to the case, dismissed the cross-petition. Sharpe was granted a decree nisi for dissolution of marriage. Mr. T. J. Hughes appeared for Sharpe and Mr. F. Curran for Mrs. Sharpe.


(Jun 1941). HUSBAND MUST PAY ALIMONY. Whether permanent alimony should be paid by a husband who had been forced into an admission of adultery yet was successful in getting a divorce because of his wife's desertion was keenly argued in the Supreme Court today. The Judge decided that effect should be given to a report of the Registrar calling upon railway worker Charles Edgar Sharpe to pay permanent alimony at the rate of 10/- a month to Edith Winifred Sharpe. . . . subject to the wife remaining 'chaste and unmarried.'
