Darius B. Lucky observed firsthand the effects of Reconstruction in Texas. He was Registrar of Voters in Smith County.

He testified before the U. S. Congress in the case of Whitmore vs. Herndon. Whitmore was the Republican candidate for Congress and Herndon the Democrat. The witnesses discussed violence and threats of violence in the congressional election of 1871. Lucky testified as to the number of registered Republican and Democratic voters in the county, and the relative strength of each vote in the 1871 election. When asked if he was a Republican, Lucky testified: "I am." When pressed as to which candidate he voted for, Lucky would not say, only that he did not vote for Herndon.
