Theodore died intestate as the result of a vehicle accident that occurred on 18 July 1931 while returning home with his son Wesley after delivering a crop of peaches to Durham, all as revealed in the probate of his estate. Theodore's wife, Norvenia, and son Floyd were administrators of the estate and, as such, filed a complaint against the owner and driver of the other vehicle. They asserted that the other vehicle, an automobile, was moving "at a high and unlawful rate of speed and in a careless, negligent and reckless manner" and "for some unaccountable reason" swerved off of the road it was travelling, "cut to its right across a filling station lot ... and ran into the side of the truck"; further, that the other vehicle "knocked said truck about ninety (90) feet from the place where it was struck". Theodore suffered multiple traumatic injuries, including a fatal skull fracture, from which he died the following day. The defendants denied responsibility, and the complaint was eventually settled for $3,740 - little more than 10% of the $35,000 claimed.[9]

Theodore's very legible gravestone can be seen on his Findagrave memorial, providing precise dates of birth and death.[10]
