Compeared Simon Smith residing in Claphoull aged twelve years who declares, on a Sunday afternoon about three weeks ago I was out in the field attending our cattle where I saw James and Simon Malcolmson sons of John Malcolmson residing in Claphoull and Adam & Laurence Malcolmson sons of Simon Malcolm- son residing in Gott and a girl Kirstie Smith. A boy of the name of John Laurenson was with me. The Malcolmson boys began calling me & John Laurenson nicnames and threw bungles at me and we called them names in return. We did not throw any thing at the boys but Jamies Malcolmson having thrown off my cap I did the same to him & he afterwards took away my neck napkin. We had some farther scuf- fling & I went towards home. On my way John Malcolmson came up to me & challenged me for medling within his boys. He cursed for me & laid hold of me by the neck and then struck me with his fist four times about the head & breast. He knocked me down and when I was on the ground he kicked me with his foot in the back. I was very ill after it. No body came to my assistance but two women who were at a little distance roared at him when he let me go. My back was very much pained & my mother took blood from the injured part with a razor & a horn. All which I declare to be truth and I cannot write.

Re-interrogated. Declares my father took me to Lerwick eight days after the above occurrence & applied to Doctor Cowie as I was very ill. The Doctor gae some things to rub my back & said it was blue & injured.

Compeared Grizel Halcrow or Smith wife of Magnus Smith residing in Claphoull aged about sixty years.
On a Sunday afternoon about three or four weeks ago I saw John Malcolmson of Claphoull came out from his house apparently in a passion and go up to Simon Smith son of George Smith who was coming towards him, and he struck Simon two blows with his fist in or about his head. The boy fell to the ground but recovered himself and got up again & took up a stone in his hand seemingly as a threat. John called out to him to lay it down which he did & John then kicked him in the back with his foot & knocked him down a second time. Isabella Gordon wife of Laurence Gordon called out to John to let the boy be and he did nothing farther to him. The boy was crying very much. I do not know whether there was any injury done the boy as I did not see the boys person after the occurrence.
All which I declare to be truth & I cannot write.

Compeared Isobel Laurenson or Gordon residing in Claphoull married aged fifty eight years who declares I am wife of Laurence Gordon.
I knew John Malcolmson fisherman who resides in Claphoull. I also know Simon Smith son of George Smith another neighbour. On a Sunday afternoon about four weeks ago as I was coming out of my own door I heard a noise to the eastward of my house & on looking in that direction I saw two boys coming along the road but I did not recognize them. John Malcolmson went from his own house towards them and I saw him strike one of theboys two or three times about the head. I thought it was one of his own boys that he was chastising. The boy roared out “I was not the first medler.᾿ The boy fell down but I cannot say he was at his length on the ground. He recovered himself & I saw John lift his foot & kick him and he fell a second time. I called out man that was an unhappy strike to give the boy, be merciful. John did not touch him again. I still thought it one of his own boys until Grizel Smith who was nearer them than me said it was George Smiths son Simon.
All which I declare to be truth and I cannot write.

Compeared Ann Smith residing in Claphoull aged forty five years married, who declares I am wife of George Smith residing in Claphoull.
I have a son named Simon aged twelve or thirteen years. On a Tuesday about four weeks ago I sent my boy out for some peats. He came home with only half a kaisie full and I asked the meaning of it. He said his back was sore and that he had been knocked down & kicked on the back on the Sunday afternoon previous by John Malcolmson. I examined his back and found a large blue spatch about the size of my hand on the back. I took horn blood from the place but as it continued bad looking I sent him to Doctor Cowie with my husband. The Doctor gave him some plasters which relieved him. He has suffered a good deal of pain from him(?) since and is still unable to do his usual work.
All which is I declare to be truth and I cannot write.
