Canadian who at a court-martial was sentenced to death for high treason, but his sentence was commuted to deportation to Australia. He is the only Canadian exile not to return as he settled and stayed in Australia.

Birth - Joseph Marceau (Marseault per the record) was born on 24 Jan 1806 in Saint-Jean-sur-Richelieu, Bas-Canada and was baptized the next day at L'Acadie, Bas-Canada. He was the son of Jacques Marseault and Archange Bourgeois.[1][2]

1st Marriage - He married Émilie Piedalue, minor daughter of Paul Piedalue dit Prairie and Louise Boudreau, on 5 October 1830 in L'Acadie (Sainte-Marguerite-de-Blairfindie), Bas-Canada.[3] [4][5] There are 4 children born to this marriage, one of whom is known to have married in the area, while living in Montana, and another married also.[6] Emilie Piedalue died in 1839.[7]

Conviction / Transportation A farmer and weaver, Marceau endorsed the patriote cause in 1834. In the general elections of Lower Canada, he voted for Louis-Joseph Papineau and supported the 92 Resolutions. A member of the Association des frères chasseurs, he took part in the rebellions by commanding a troop of 50 patriotes at the Napierville camp from November 3 to 9, 1838. After having taken part in the battle of Odelltown (Lacolle), he was imprisoned in Montreal the following November 22.

Marceau was court-martialed from December 24 to January 2, 1839. He was sentenced to death for high treason, but his sentence was commuted to deportation to Australia. He is exiled with 57 others. In 1844, he remarried and decided to settle in Australia. He is the only exile to have settled there."[8][9].[10]

Note that the term “patriot” is in the eye of the beholder. French-Canadians mIght regard Marceau as a patriot, but Canadian history books, at least the English language ones, would call him a “rebel”.

Both the rebellions in Upper Canada and Lower Canada in 1837 and 1838 were put down. One of the leaders of the rebellion against the governing structure in Upper Canada (now Ontario) was a publisher named William Lyon Mackenzie.

William Lyon Mackenzie (1795-1861) served as Mayor of Toronto and is also honoured by Canada Project. The Upper Canada and Lower Canada Rebellions are recognized by historians as hastening the arrival of responsible government in Canada.
