Henry County, Virginia. This second day of February in the year of our Lord eighteen hundred and forty-two. I make the following distribution.
First, After my death I desire that all my debts and funeral expenses may be paid.
Second, I give to my son Lewis R. Marshall seven hundred dollars, which I have advanced to him and paid for him as his security.
Thirdly, Besides the seven hundred dollars above named I have paid for him as his security nearly nine hundred (900) dollars, which may be readily discovered by reference to my book of accounts. I am still his security for a considerable amount, say from six hundred to one thousand dollars. All this money that I have paid to and for him as his security, and the balance which I shall probably be compelled to pay, I distribute as follows:
I give to my Grandson Dennis Conway $100, to my daughter Martha H. Conway, wife of Benjamin Conway, Polly A. Dempsey, wife of Dubartis Dempsy, Sally W. Wingfield, and Frances W Gravely, wife of John Gravely, all the balance of the money except the parts given to L.R. Marshall, and that I bequeath to Dennis Conway. All the balance of my property both real and personal of every description I give to my son Benjamin A. Marshall and daughter Casandra Clark to be equally divided between them, which they can probably do to the satisfaction of themselves. But I must by no means neglect my sister Nancy, who is living with me, and who has been living with me many years. Should she survive me, I desire that a competency may be applied to her comfortable support. If it should be necessary to sell the negroes on account of debt, or on account of their unwillingness to go to the West, it is my desire that they be sold to men of humanity and as near to each other as possible, that they may have the satisfaction of seeing and conversing with one another frequently.
I hereby appoint my son Benjamin A. Marshall Executor of this my will.
Dennis Marshall (Seal.)
At a court for Henry County at the Courthouse, 11th December 1843 the foregoing paper purporting to be the last will and testimony of Dennis Marshall, decd, was produced in court, proven to be in the proper handwriting of said Dennis Marshall, and ordered to be recorded; Whereupon Benjamin Marshall, the executor therein named, qualified as such, and with James A. (?) old and George Eggleton, his securities, entered into and acknowledged a bond in the penalty of six thousand dollars conditioned according to Law.
