Osborn, and with his and Jacob Rogers and John Martin who are persons of respectability and credit to the court here well known, who being dully sworn at their oaths firm to the satisfaction of the court that James Martin who was a private in Capt. Patrick company in the Regt. of Ark. Mtd. Vols. [Mexican war] that said Martin in his life time received for his service [two] 160 acres. That on or about the 7th day of December 1850 [7th day of July] said James Martin departed this life intestate, that the only heirs of law of said James Martin were Sarah Lynch, formerly Sarah Martin who intermarried with Joseph Lynch who resides in Illinois, Elizabeth Smith who resides in the State of Alabama both of whom are sisters of decedent and his brothers Edmund T. Martin, William Martin, Solomon Martin and John Martin who reside in this State, and that as the decedent left no wife child, or children, father or mother him surviving, said sisters and brothers are the only heirs at law of said James Martin deceased.
