INTERPRETATION OF A WILL Otago Daily Times ISSUE 17085, 17 AUGUST 1917 [4] MAUNDER v. MOGINE. His Honor Mr Justice Sim yesterday morning gave judgment in the case of Maunder and others v. Mogine, the question involved being really the interpretation of a will. The judgment, in a condensed form, read;— The testator, George Maunder died on November 17, 1914, leaving a will and two codicils. Probate of these was grafted to Emma Maunder, the testators widow the executrix appointed by the will, the plaintiffs are the trustees of the will. The estate was valued at £21 567 3' for purposes of the Death Duties Act. Estate duty was assessed at £1509 14s 5d, and this was paid by the trustees out of the capital of the estate. There was no succession duty, payable in respect of the estate. The testator's widow died on June 28, 1916, intestate, and administration of her estate was granted to her son, the plaintiff, George Hillary Allard Maunder For the purposes of the present proceedings the defendant, who is a daughter of the testator, and is interested in both estates, has been appointed to represent the administrator of the widow's estate and all those beneficially interested in that estate.....
