Margaret Foster Will

In the name of God amen I Margaret Foster of the town of Camden in the County of Ray and State of Missouri being of Sound mind and Memory (Blessed be Almighty God for the Same) do make and publish this my last Will and Testament.

First I Give and bequeath to my daughter Eleota C. Hopkins of Clermont County Ohio all of my personal property at my decease after paying all my indebtedness and funeral expenses.

Second I further give and devise to my son John D Foster his heirs and assigns all my Real Estate situated and being and lying in Ray County Missouri to wit: The West half of the North East quarter Section no. Seven (7) town fifty (50) also apart of the East half of the North West quarter section seven (7) town fifty (50) Range twenty seven (27) Supposed to be about Eighty Seven acres in all as fen division line run between my husband Isaac Foster and Ogden Harvey. The above to be my son John D. Foster at my decease.

Third And I further devise that my son John D. Foster share pay to each one of my heirs to wit unto Nancy Weaver my daughter of Clermont County Ohio the sum of five dollars unto Thomas Foster my son the sum of five dollars. Unto my daughter Sarah Pine the sum of five dollars. Unto my son George W Foster the sum of five dollars. Unto James Foster my son the sum of five dollars. Fourth I do nominate and appoint William J. Brasher of Camden Missouri to be the Executor of this my last will and testament.

In Testimony whereof I have here to this my last will and testament contained on one sheet of paper and to the said sheet thereof subscribed my name and set my seal and to this sheet thereof I have here subscribed my name and affixed my seal this 4th day of June in the year of our lord one thousand eight hundred and sixty nine

I the undersigned judge of the Camden Peas Court of the County of Ray aforesaid and in offices Clerk of said court in the transaction of business in the probate Branah thereof hereby certify that the above and foregoing will was this day admitted to probate and duly sworn and established as the last will & testament of Margaret Foster now deceased. Before me upon the oaths and testimony of John Mason and Robert P Ballew the attending witnesses to said will and which said testimony was by me sweared to writing and signed by said witnesses and filed in this office. In witness whereof I Charles I Hughes as judge & in office clerk of said court have here to subscribed my name and affixed the seal of said court at my office in the city of Richmond in said county of Ray on this 3rd day of February A.D. 1873.

Be it remembered that on the third day of February 1873 personally appeared before the undersigned judged of the Common Plea Court of said county of Ray in vacation John Mason and Robert P Ballew who being duly sworn upon their oaths depose and say that they were present and saw Margaret Foster now deceased sign the aforesaid instrument of writing which purports to be the last will and testament of the said deceased; that at the time of signing the same the said Margaret Foster was of sound and disposing mind and memory; And that these defendants subscribed their names thereto as witnesses to the same in the presence of said testators and of each other John Mason Robert P Balleu and Charles W. Shatwell and at

Letters Testamentary State of Missouri County of Ray To all to whom these presents shall come greeting: Know ye that the last will and testament of Margaret Foster deceased late of Ray County Missouri hath in due form of law been exhibited, proved and Recorded in the office of the Clerk of the Common Pleas Court of Ray County Missouri a copy of which is hereunto annexed: an in as much as it appears that William J Brashear has been appointed executor in and by said last will and testament, to execute the same and to the end that the property of the said testator may be preserved for those who shall appear to have a legal right or interest therein, and that the said last will and testament may be executed according to the request and instruction of the said testator we do hereby authorize him the said William J Brashear as such executor to collect and secure all and singular the goods and chattel right and credits which were of the said Margaret Foster at the time of her death in whosesoever hands or possession the same may be found; and to perform and fulfill all such duties as may be enjoined upon him by said last will and testament so far as there shall be property and the law charges him: and in general to do and perform all other acts which are now or may be hereafter required of him by law. In testimony whereof I Charles J. Hughes Judge & officer Clerk of the Common Pleas Court in the aforesaid county of Ray have hereunto signed my name and affixed the seal of said county of office in Richmond this third day of February A.D. 1873 Charles J Hughes Judge & Office Clerk of Common Peas Court “Bond” Know all men by these presents: that we William J Brashear as Principal and A.D. Brasher and James R Akers as securities acknowledge ourselves to owe and be indebted to the State of Missouri in the sum of three thousand and dollars for the payment of which we bind ourselves jointly and severally by these presents Witness our hands and seals this 3rd day of February A.D. 1873. The condition of the above bond is such that if the said William J Brashear Executor of the last will and testament of Margaret Foster shall faithfully administer said estate and execute said last will and testament and account for and pay and deliver all money and property of said estate and perform all other things touching said administration required by law or order of any court having jurisdiction then the above bond to be void otherwise to remain in full force
