Riverine Herald (Echuca, Vic. : Moama, NSW : 1869 - 1954; 1998 - 1999), Wednesday 12 May 1909. [2] DESERTION. The case of Mary Ann Morgan against Albert Sutton, charged with deserting his illegitimate child, remanded from last week, was again brought on for hearing. Mr Mueller appeared for the complainant, and Mr Atkyns for defendant. Mary Ann Morgan, residing at the Village Settlement, deposed she had known Sutton for about two years. He was the father of the child. The P.M. - You have not told us how you know he is the father of the child. It would be necessary to give more evidence to prove the fact. Mr Mueller - For the sake of sparing details, I have not asked more questions. I have corroborative evidence. Witness, continuing, said she last saw defendant on the Monday after Boxing Day. She asked him his intentions, as he had promised to help her and had not done so. He told her he was going to Queensland on New Year's Day, and she could do her best. Mrs Morgan, mother of complainant, gave evidence that she had seen Sutton on Boxing Day, when she asked him why he had not carried out his promise to help complainant. She told him if he would only make her daughter his wife she would help him. He said he was going to Queensland after New Year's Day, and if she had sufficient money she could bring him back. She had seen her daughter in company with Sutton on two occasions, when he had brought her home to witness' place. The first time was on Good Friday, and the second during July. Mr Atkyns held there was absolutely no corroboration. Mr Mueller - Clearing out is held to be corroboration. I can produce authorities to show this. The P.M. - Yes; both daughter and mother have given evidence that they had been told to find sufficient money to bring him back. He was quite satisfied this was corroboration. Mr Atkyns said his client would not go in the box. The P.M. - It is a civil case, and he should be made to go into the box. He must be asked as to his means. Defendant, questioned by Mr Atkyns, said it was nine or ten months' ago since he went away. He had been in Williamstown for three months. He then went to Perricoota, where he had been working for £1 a week and his keep. He thought he could get work if he went back there. An order was made against Sutton to pay 6s per week, payable fortnightly, the first payment to be made on Tuesday next. Costs amounting to £2 7s were allowed complainant. Mr Atkyns said defendant was unable to obtain surety for the fulfillment of the order, and if forced to do so there would be no alternative but to go to gaol. Mr Mueller, after consulting complainant and her mother, informed the Bench that a surety would not be insisted upon.
