Will of Francis Oats, farmer of Marazion will dated 3rd May 1848 Double probate April 1873 St Hilary 12th April 1851 Will of Francis Oats, farmer, deceased proved in common form before Henry Elliot Graham Clerk by virtue of a commission & and Admon of all and singular the goods etc of the said dec’d and any way concerning the said will was granted to Margaret Oats the widow of the said dec’d and Executrix named in the will. Reservation to Francis Oats and Josiah Oats the sons and executors. Being first sworn savings, effects were under £200 died 30th July 1850 Stamp £2 Preston Wallis, Cy. Registrar

Double Probate passed at Bodmin April 1873

This is the last will and testament of me Francis Oats of the town of Marazion I the county of Cornwall, yeoman. I desire that my just debts and funeral and testamentary charges be paid by my Executrix and Executors hereinafter named and subject thereto respectively.

I give and bequeath to my granddaughter Mary Jackson the sum of one pound per annum to be paid and payable out of the money of my property hereinafter bequeathed to my sons Francis and Josiah Oats and which I hereby charge therewith, to hold to her during the residence of my ????? Estate and interest therein with full power for her to dispose of the same by will or other instalment in writing to either or both of my said sons Francis and Josiah or their or his issue but to no other person or persons whatsoever. I give and bequeath to my dear wife Margaret Oats all that my leaseholds, tenements and premises with appurtenances situate in the town of Marazion aforesaid and now in the occupation of Mr Congdon Surgeon and others ……. And which I hold under a lease from his Grace the Duke of Leeds to hold the same to my said wife for the term of her natural life (if my estate and interest therein shall so long continue) subject to the rents and covenants in the indenture of lease thereof reserved and contained.

Also I give and bequeath all the residue and remainder of my personal estate and effects whatsoever and wheresoever situate unto my said wife during her life and from and after her decease I give and bequeath my mahogany clock to my son Francis. I give and bequeath to my sons Francis and Josiah one full moiety or half part undivided of and in my said Leasehold premises at Marazion aforesaid to hold to them their executors and administrators from and immediately after the death of my said wife for all the residue of my term? Estate and interest therein as tenants in common and not in joint tenancy.

I give and bequeath the other undivided moiety of my said premises at Marazion aforesaid unto my daughters Grace Roberts and Catherine Corin and Margaret Williams to hold to them their Executors and Administrators from and after the death of my said wife for all the residue of the erm estate and interest therein as tenants in common and not as joint tenants. All the rest and remainder of my goods, chattels and effects whatsoever and wheresoever I give and bequeath to my said daughter Grace, Catherine and Margaret to be equally divided amongst them share and share alike. and I hereby will and direct that in case either of my said sons shall die without leaving lawful issue his share shall go and be held and enjoyed by the survivor of them paying thereout unto the widow (if any) of his so dying the sum of fifty shillings per annum and in the case of the decease of both my said daughters Grace, Catherine and Margaret and the widows (if any) respectively of my said sons in equal shares and proportions as tenants in common. and I further will and declare that it shall not be lawful for either or any of my said sons or daughters or daughter in laws respectively to dispose of or in any manner part with by sale or mortgage or otherwise, his her or their share or shares of and in the said premises so given and bequeathed to them respectively as aforesaid and in case either of my said sons shall attempt to sell or forfeited to be held and enjoyed by my said daughters Grace, Catherine and Margaret in equal shares, And in case either of my said daughters and daughters in law shall attempt to sell or mortgage their said share the same shall thenceforth be forfeited to and be held by my said sons Francis and Josiah share and share alike as tenants in common. And I hereby nominate constitute and appoint my said wife Margaret Oats and my said sons Francis and Josiah joint executrix and executors of this my will hereby revoking all former wills or will and declaring this to be my true and only last will ant testament. In witness whereof I have hereunder set my hand the 3rd day of May one thousand eight hundred and forty eight
