  2. Source: #S64 Mildred Odom et al vs John Turner Administrator., Isaac Odom and William Odom Discovery and Distribution Filed 5 December 1828Petitioner Mildred is the widow of George W. Odom, late of Barnwell District, deceased, and brings this petition for herself with her minor children Elizabeth, Seybert, and Sarah Odom, infant children of the said deceased, the minors appearing by their guardian James Potter. It is alleged that Seybert Odom, the father of said George W. Odom, died intestate [date left bland] in Barnwell District, leaving an estate valued at $10,000 or other large sum, and leaving as his only heirs at-law his two children, viz the said George W. and a daughter who has since married John Turner, of said district.John Turner became admr. on Seybert Odomís estate, and later upon the death of Geo. W. Odom, he became admr. on his [George W.] estate also. Petitioners are the only heirs-at-law of said Geo. W.It is stated in an amendment, also that said Seybert Odom, deceased, had an illegitimate son who many years before had moved to the western or southwestern country, named Isaac Odom, who died before his father [Seybert] did, leaving three sons two of whom are Isaac and William Odom, and that it is a fact well known that Isaac Odom was not born in wedlock, that he was illegitimate and that his children or other representatives cannot take any part of the estate.Defendant John Turner in his answer says that Isaac Odom was a whole brother of said George W., and of his [Turner] wife, but it has been said that he was born before his parents married, but defendant Turner himself is ignorant of the true facts; the said Isaac died several years before his father [Seybert] did, leaving three children, two of whom now or lately were living in Alabama, and defendant was informed by said Geo. W., who had previously been in Alabama, that the said children intended to contend for a part of the estate of their grandfather Seybert Odom. After that, George W. Odom died.Testimony showed Geo. W. Odom died at John Turnerís house and Turner furnished his shrowd clothes, viz., one pair of panteauloons, a mourning gown, one pair of stockings, two hankerchiefs, one shirt and one sheet; Odom had been sick about a week in Turnerís home. Turner also had a coffin made.A commission was issued for taking the testimony of Daniel Odom, Sr., "an aged and inform witness" in this case, but same is not in the file. The decree dated 2 February 1830 states that the said Isaac and William Odom had been made parties to the case by amendment, and had been served by publication and had filed no claim, therefore they were precluded from participating in the estate. The estate was decreed to belong one-half to petitioner Mildred Odom and her children, and the other half to Turner Smith in right of his wife.In the file is a certified copy of appointment made Dec. 3, 1827, of James Potter as Guardian of the minors of George W. Odom, and certified as having been made by the Court of Ordinary of an undesignated county, and certified to by R. Harvey, clerk of Court of Ordinary, evidently of some county in Georgia. Nowhere is the county and state shown; the Justices of Inferior Court present and presiding on Dec. 3, 1827, were John Hatcher, Benj. Weatherby and J. C (?) Harvey.A receipt in the file dated 21 October 1848, signed by E. Bellinger, Jr., and J. M. Hutson as attorneys-in-fact for James A. Knight, Trustee for Sarah Carson nee Sarah Odom, under Power of Attorney dated Sept. 9, 1848, and under Power of Attorney from Turner Smith in right of his wife nee Elizabeth Odom, and Mildred Odom, individually and as Guardian of George Odom, son of Seybert Odom, decíd., in full of their balance due them for their shares in this proceeding. The Powers of Attorney are not in the file. File @M198@
