Their first child, Jubal, was born prior to their marriage (December 8, 1787) and is even referred to as "illegitimate" in James' Will.
Their second child, Nancy, was born in 1789. It is unknown whether Amy died or whether they divorced.
James married Sarah 'Sally' Anderson on November 29, 1802 and they had 12 children together.
The first recorded land purchase for James in Bedford County, Virginia was May 20, 1788. It was for 16 acres and was purchased from John Dollar. This is approximately the time he married Amy.
James' Will was written in Bedford County, Virginia on December 31, 1841 and proven in November 1842.
"In the name of God Amen. I, James Payne, of the County of Bedford and the State of Virginia being at present in health and disposing mind and memory but considering the uncertainty of this mortal life do make and ordain this my last will and testament in manner and form following.
First and principally I commend my soul to God who gave it and my body do commit it to the earth to lie decently intended at the discretion of executor unless I shall hereafter give other discretions respecting the same as to such wordly estate as God of His goodness hath bestowed upon me. I give and dispose of in this manner hereinafter mentioned, that is to say, in the first place all my just debts are to be paid out of my estate and in the second place it is my wish and desire that my wife Sally Payne shall live upon and enjoy the balance of my estate after paying my debts her life time for a support to her and such of her children as are now with her and such as may remain with her unmarried including Jane Richardson and her children as long as she continues sepearated from her husband Washington Richardson from whom she has been compelled to seperate in consequences of his ill treatment of her and after the death of my wife Sally Payne the whole of the balance of my estate both real and personal I will bequeath to those of my daughters whose names follows, That is to say
Jane,
Elizabeth,
Lucinda,
Louisa,
Margaret and
Lucy
to be divided equally among them but should my first named daughter Jane go back to her husband and take up with him and live with him I hereby declare and will that she shall forfeit her interest herein before provided for her and the whole of my estate or the balance of it after paying divided among my other named daughters Elizabeth, Lucinda, Louisa, Margaret and Lucy.
As to my other children I shall name them and assign reasons for not making any provisions for them in this my last will and testament;
Jubal Payne - an illegitimate son is well off and needs no assistance.
Nancy Payne - who intermarried with Robert Harrison I have done for he all I am able to do in justice to younger children.
William Payne - deceased, I have done as much for him in his life time and for his children as I am able to do, in fact they were for a considerable time a heavy charge upon me.
James Payne - I have done all for him I am able to do.
Joseph Payne - I have also done as far as I am able to do.
John Payne - I have also done as much for him as I am able to do.
And for my youngest son, Braddock Payne, has already cost me more than I am able to give any the rest of my children and therefore can not reconcile it to any consciences to give him anything more.
And I hereby constitute and appoint my wife, Sally Payne, sole executor or executive of this my last will and testatment hereby annulling all wills by me at any time heretofore made. "The subject of the dispute over Joseph Payne's will was that he apparently had a deathbed change of heart and willed all of his property to one son, James Payne, rather than the equal distribution to all of his children that he had previously mentioned. Joseph's other children were Thomas Payne, Joseph Payne, John Payne, Obadiah Payne, Barnett Payne, Lucy Stanley, Betsey Crabtree, Susannah Slinker, Nancy Brown, and Dicey Brown, and all received one dollar apiece."

This is the correct Will and if you need proof look on Bing or Google and it will prove that he had a daughter named Elizabeth which you omitted when you put it on Find A Grave.
Elizabeth Mae Payne was my 3rd Great Grandmother and I have been doing genealogy for over 20 years and Sarah Anderson was her Mother.
I never posted anything about James Payne for the simple reason there is no proof that he married Amy Chaffin. It says on the interenet they thought he was married twice but no proof. And he did marry Sarah " Sally" Anderson. Also he omitted putting in his will three other children one was William Payne which could have been a son of Amy Chaffin. Another daughter not mentioned in his will was Phebe Ann Payne, and Mary Alsy Payne she married Churchwell Newnham. Phebe married Richard Ferguson and William Payne was married to Elizabeth A Anderson. Reason I said could have been a child of Amy Chaffin because everyone has him being born in 1802 and he married Sarah Anderson I think in November 1802. There is so much controversy on James Payne first reason because of his father Joseph Payne's Will.
I just hope you put the correct Will on James Payne's Memorial, he was the father and grandparent of hundreds of families that descended through his linage.
