Joseph Payne was born on 23 March 1758 in Goochland County, Virginia, and christened in the St. James Northam Parish on 16 April 1758.[1]

In the Spring of 1776 he enlisted as a sergeant in the Ninth Virginia Regiment under Col. Thomas Fleming and in May 1777 was promoted to ensign in Capt. Smith Sneed's company. He was captured at the battle of Germantown, Pennsylvania, along with his company and became a prisoner of war for the next three years.[2]

While a prisoner in Long Island, New York, he married Ann Van Cleaf on 31 December 1779.[2][3] Their first child, Ann, was born while he was still a prisoner. He was freed through an exchange of prisoners November 1780, returned to service, and was promoted to Lieutenant before he resigned on 18 February 1781.[2]

His pension records identify the following children born to Joseph and Ann Payne:[2]

  • Richard, born 20 November 1782
  • George V.C., born 19 August 1785
  • Cornelius, born 30 July 1788
  • Jesse, born 25 December 1790 and died prior to 1807
  • Joseph, born 28 February 1792
  • Robert, born 8 December 1795
  • Mary, born 26 December 1798
  • Elizabeth, born 6 September 1800
  • Lavinia or Lavina, born 15 March 1804

In 1807, the family moved to Bath County, Virginia. He died on 5 April 1826[4] and his wife Ann died on 14 February 1847. Five of their children survived their mother: Richard, George V.C., Joseph, Ann (Payne) Johnson, and Lavinia (Payne) Howell.[2]
