James was born on Christmas Eve, 1834 in Birmingham, Warwickshire, England. He is the son of Frederick Payton and Ann (Downes) Payton. [1]
1836 - James was Christened at St Phillips, Birmingham, Warwickshire, England. [1] [2]
1841 - James, 6 years old, is recorded living with his parents Frederick Payton (age 40), and Ann (Downes) Payton (age 40), and 5 siblings, at Barretts Heath, Kings Norton, Worcestershire, England.[3]

1851 - James, now 16 yrs old, is employed as a Brick Maker, like his father and older brother Samuel. He is living at home with his parents and siblings, but home is now 30 Saltey Rd, Aston, Warwickshire, England. His parents Frederick Payton and Ann (Downes) Payton are now both 50 years old, his siblings are all still living at home and he has a new little sister, Rachel (age 3). [4]
In 1952 sadly his little sister Rachel Payton passed away, age 5, which must have been a blow to the entire family.
On 15 May 1859, James Payton married Jane Martin, in St Edburgha’s Church, Yardley. This is the oldest Church in the entire Birmingham area, with parts of the church dating from the 13th century. [1] James is recorded as being a Labourer, as is his father Frederick Payton, and the bride's father also, John Martin. The witnesses who signed the Register were siblings of the bride, Henry Martin and Anne Martin, who later married James younger brother Thomas Payton.[5]
James and his wife are missing from the 1861 Census.
In 1871 he is 36 years old and living with wife Jane at 41 Warwick Rd, Yardley, Birmingham. They are not recorded as having any children but have taken in boarders. His now elderly parents are living at 49 Warwick Rd, and his brother Thomas N. Payton was living just up the road at 56 Warwick Rd, with his family.[6]
In 1881 he is 46 and still living in Warwick Rd with wife Jane who has started her own business doing laundry, and has taken on 2 assistants who are staying with them. Also in the home is Sarah Ann Francombe, age 9, James niece, daughter of his sister Rachel.[7]
In 1891 he is only 56 but is an invalid living with wife Jane in a cottage in Shirley Rd, Yardley, Worcestershire, Jane is still running her laundry business, and has a young girl from Glasgow living with them and helping with the laundry, and their niece, Jane Martin (24 years old, his wife's namesake) daughter of his wife's brother Henry Martin, is also there, possibly helping to care for him while her Aunt works. In Jan 1900 his wife Jane Payton (nee Martin) passed away. They may have taken her to the Workhouse Infirmary, which was a closest thing to a hospital in those days, because she is recorded as dying at Solihull, Warwickshire. In truth it was to become Solihull Hospital only a few years later. [9] [10]
In 1901 James is 66 years old, a widower living alone. He is still living in Shirley Rd in a small Cottage and works as a Gardener (domestic). [11]
In 1901 James, age 66, married Rachel Birks, age 29. [12] Rachel was a domestic servant and a single mother. with a 9-10 year old daughter. Florence was living with Rachel's sister Clara, she would later take her stepfather's surname, Payton.
James and Rachel lived at 82 Walsingham Street, Walsall, Staffordshire, England. In spite of his age, he father's 3 children, with Rachel over the next 10 years.
In the 1911 census James (age 76), Old Age Pensioner, was the married head of household at 82 Walsingham Street, Walsall, Walsall, Staffordshire, England. The household consisting of his wife and 3 children. His wife Rachel is taking in Washing (as his wife Jane used to do), to help financially support the family and his 2 eldest children. James and Ida are attending school. [13]
James's death (age 76) was registered in the Jul-Aug-Sep quarter of 1911 in the Walsall district, Staffordshire, England.[14]

There are more direct male descendents of James Payton living, who have taken Autosomal DNA tests but who are not Wikitree members and do not wish to be identified on Wikitree at this time. I have searched my DNA matches and found 5 DNA matches, with surname "Payton" in their Family Trees, ranked as 5th - 8th cousins currently residing in the USA.
