Private Henry Peek served with Richmond County Militia, Georgia Militia during the American Revolution.

Henry Peek is a DAR Patriot Ancestor, A086883.

This Henry Peek was the Revolutionary War vet referred to in the pension documents referenced below. This family is often confused with a different Peek family who lived in Georgia at the same time, but in a different region of the state. This Henry Peek lived in Newton County, GA in 1830 and moved to what is now the Cedar Valley of what was then Paulding County, GA, in northwest Georgia, in the fall of 1833. Later, the Cedartown area became Polk County. When Henry Peek died, he was not age 100 as was reported at the time, but around age 91. His wife was named Sarah Phelps. A granddaughter was named Sarah Jemima Elizabeth, but there is no evidence that Sarah had those middle names. Their marriage record calls her Sarah, with no initials or middle names.

State of Georgia and County of Newton; On this 24th day of December, 1832, personally appeared in open court before the Judges of the Inferior court now sitting Henry Peek a resident of Newton County and State of Georgia, aged 66 years who being first duly sworn according to law doth on his oath make the following declaration in order to obtain the benefit of the act of Congress passed June 7th 1832. That he entered the service of the United States under the following named officers and served as herein stated Colonel Elijah Clarke commanded the Regiment and Captain John Peek commanded the company and Seth Thompson commanded as first Lieutenant. That he entered the service the first time on the 7th day of January 1781 and left the same sometime in the month of July 1781 making a tour of 6 months. That he entered the service the 2nd time the first of August 1781 under the command of Colonel Elijah Clarke and Captain Ezekiel Stallings and left the sometime in the month of September 1781 making a tour of one month. That he served both times as a volunteer. That at the time he entered the service he resided in Richmond County in the State of Georgia. That he was in the battle of the Siege of Augusta. That he served with Colonel Lee's Continental Regiment at the Siege of Augusta. That he knew Colonel Lee & Colonel Ferdinan Oneal [Ferdinand O'Neal] Continental officers. That he entered the service the first time at the age of 15. That he marched through no Country except the State of Georgia. That he has no documentary evidence and that he knows of no person whose testimony he can procure who can testify to his service. He hereby relinquishes every claim whatever to a pension or annuity except the present and declares that his name is not on the pension roll of the Agency of any State. Sworn to & subscribed, the day & year aforesaid. S/ McCormick Neal, JIC S/ Henry Peek [Turman Watshall and John N. Williamson gave the standard supporting affidavit.]

Application for a New Certificate State of Georgia County of Polk On this 6th day of August 1856, before me, the subscriber, a Justice of the Peace for the said County of Polk personally appeared Henry Peek who, on his oath, declares that he is the same person who formerly belonged to the company commanded by Captain John Peek in the Regiment commanded by Colonel Leonard Marbury in the service of the United States; that his name was placed on the pension roll of the State of Georgia but has never received a formal certificate & now wishes to obtain one. S/ Henry Peek, X his mark Sworn & subscribed to, before me, the day and year aforesaid S/ Thomas A. Chisolm, JP [William Peek gives a supporting affidavit -- there is no indication of the relationship, if any, between William and Henry.]

State of Georgia County of Polk: Be it known that before the undersigned a Justice of the Peace in and for said County personally appeared Henry Peek aged about 100 years a resident of the said County and State who being sworn according to law declares that he is the Identical Henry Peek who was a private Soldier in the Revolutionary War for which service he was in the year 1833 placed on the Georgia Pension Roll at $23.33 per annum that he received the pension for a number of years through his Agent: when through the neglect of said Agent to attend to drawing the money his Pension has not been received for 10 years or more he cannot recollect the exact time -- the name of the said Agent was Storrs he the Pensioner has not the Pension Certificate in his possession and he does not know what has become of it unless it was taken by the Agent who used to draw his pension more than 10 years ago. He makes this declaration for the purpose of obtaining from the proper Officer at Washington them out of arrearages of said Pension from the time of the last pavement thereof to the present time. He also request that the draft of the amount of such arrearage may be delivered to the care of William Hunt of Washington City DC who is hereby authorized to receive the same as his attorney for that Purpose. S/ Henry Peek Sworn to and Subscribed before made this 28th day of October A.D. 1853 and I hereby certify that I believe the said Affiant to be the Identical Henry Peek who was a US Revolutionary pensioner and that he is of the age of of stated I also Certify that I am not personally or other wise interested in this matter. S/ Thomas A. Chisolm, JP [fn p. 50: the veteran made another full application dated September 24, 1833, filed in Newton County Georgia and almost word for word the same as the application filed in December 1832, except with the addition of the following: "... That he was born in Loudoun County State of Virginia on the 25th of December 1766, that he has no record of his age, his father had one, but the same was destroyed by fire, that he was living in the County of Richmond in the State of Georgia when he entered the service each time, that he continued to reside in Richmond after the Revolutionary War, until that part of Richmond County upon which he then lived was added to & became a part of the County of Columbia, in which said last mentioned County to wit Columbia he lived many years from thence he moved to the County of Putnam in the State of Georgia, where he resided many years, from thence he moved to the County of Newton State of Georgia his present residence, at which said last mentioned place he has resided for the last 9 years, he entered the service each time as a volunteer, he knew Colonel Lee who was with the Troops at the siege of Augusta in the State of Georgia -- he does not recollect to have received any written discharge for either term of his service if he did the same has been lost or destroyed -- that he is acquainted with McCormick Neal and Josiah Perry persons in his neighborhood who can testify as to his character for veracity & as to their belief of his service. He hereby relinquishes every claim whatever to a pension or annuity, except the present, and he declares that his name is not on the pension roll of any State or (if any) only on that of the Agency of the State of Georgia. This profile has the most accurate info on Henry Peek and his wife Sarah Phelps, other than Henry's parents. His parents were John Peek and Tabitha (last name BELIEVED to be O'Neal, but not proven thus far). THIS Henry Peek's father John died in Putnam County, GA in 1812, with Henry as administrator. Proof is found in pension application documents that list the various locations where Henry lived during his life. THIS Henry Peek was born in 1766 in VA, not 1756. That birth year belongs to a different Henry Peek.

This Henry Peek's father was NOT John COMER Peek, who was a totally different person who lived in the same region of east central Georgia (died in Hancock County in 1816). In Hancock County, there was another Henry Peek, who was married to Judith Lockett, and this other Henry died in 1824. Estate documents prove it.

These two families have been merged online over the years, in various forms. The fact that they lived only 30-50 miles from each other at various times also made it easier for researchers years ago to get them muddled. These extended families might be related, but this Henry's father was NOT John Comer Peek.

The Henry Peek who lived in the Cedartown, GA area (Paulding, until Polk County was created) was married to Sarah Phelps. He lived in Newton County, GA in 1830 before moving to the Cedar Valley in the early 1830s. But, he was most likely NOT Henry "Haywood" Peek - the middle name belonged only to his son. There is not a single actual source record giving him a middle name. A lot of confusion was created by early 20th century research that was faulty or based on misinterpretations. Most of it can still be found online.

There are discrepancies about Henry Haywood being married to Judith Lockett. His wife may have been Sarah Phelps. I'm not sure this rev. war record belongs to this Henry Peek. More research is needed to determine the lineage of Henry Haywood Peek.
