Will of James Pettyjohn

In the Name of God Amen I James Pettyjohn Sen. of the county of Sussex on Delaware yeoman[,] being sick and weak of body but of sound mind and Perfect in my understanding],] do make this my Last will and Testament. I Resign my soul to God who Gave it hoping for salvation through the merits of Jesus Christ I Commit my Body to the Earth to be decently interred by my Executrix hereafter Nominated and as to my worldly substance I dispost of as Followeth –

Impr. I Give and bequeath unto my two sons James & Samuel the land and plantation I now live on with the building and all the appurtenances thereunto belonging[,] to be equally Divided between tem to them and their Heirs and Assigns forever[,] on Condition that they the said James Pettyjohn Junr and Samuel Pettyjohn Respectively and their Respective Heirs Executors Administrators or Assigns shall pay or cause to be paid unto my Exectuor Thirty days after my decease Each nine pounds current money of this Government to be added to my personal Estate for the uses and purposes hereafter mentioned.

Item. I Give and bequeath unto my Two sons Thomas & Jacob a tract of Land with the appurtenances thereunto belonging containing about Three Hundred acres Situate lying and being in the said County of Sussex joining South on the Long Bridge {??} northwest upon Mary Claypool’s Land and west upon other Land belonging to my Self which I bought of Elijah Kellum to be Equally divided between them to them and their Heirs and Assigns forever on Condition that they the said Thomas Pettyjohn and Jacob Pettyjohn respectively and their respective Heirs, Ex-s, Adm’s and Assigns shall well and truly pay or cause to be paid unto m Executrix thirty days after my decease Each the sum of Fifteen pounds of current Money of their Government to be added to my personal Estate for the uses hereafter mentioned.

Item. I Give and Bequeath unto my Son Abraham a Certain tract or parcel of lands situate in the said County of Sussex adjoining west upon the {?}northern mentioned land bequeathed three hundred Acres[,] Containing about One Hundred and Thirty One Acres more or less which I purchased of Elijah Kellem to him my said son Abraham his Heirs and Assigns forever to be by him the said Abraham Pettyjohn or his Heirs and Assigns enjoyed immediately after the decease of my beloved wife Hannah[;] and in case my said son Abraham should decease before my said wife hen my will is that the above bequeathed One Hundred and Thirty One Acre shall devolve to my four sons James, Samuel, Thomas and Jacob and their Heir and Assigns forever or to the Surviving of them my said four Sons their Heir and Assigns forever

Item. I Give and Bequeath unto my loving wife Hannah the possession ?? Benefits of the above mentioned One Hundred thirty one acres of Land During her Natural Life and my will is that my said wife Hannah shall enjoy the poseession of the plantation I now live on two years after my decease that she may have time to build on the above mentioned tract of one hundred and thirty one acres of Land.

Item I give and bequeath unto my son Abraham my young Bay Horse and my Saddle[,] my gun my razor and ?hoare[,] two Iron wedges to him and his Heirs and Assigns forever on Condition that my said son Abraham or his Heirs or Assigns shall pay or cause to be paid to ward the schooling of my two daughters Naomi and Major at a proper time for that purpose the sun of Three pounds Ten shillings current money of this Government to be equally divided between them.

Item. I Give and Bequeath unto my Two Daughters Naomi and Major one feather bed[,] a Rug and a blanket and Each of them a heifer to them and their Heirs and Assigns forever to be Delivered to them Immediately after my decease.

Item. My will is and I do order my son Abraham to pay toward the schooling of Mary Oglesby the sum of fifteen shillings.

Item. I Give unto my Daughter Lydia a ??{fryse} Cow called Teat to be delivered Immediately after my decease to her and her Heirs and Assigns forever Item. I Give and bequeath unto my three Daughters Sarah Nixon, Elizabeth Abel and Abigail Bignal each the Sum of five Shillings to be paid Immediately after my decease to them and their Heirs and Assigns forever.

Item. I do Order that my funeral Expenses and all my Lawfull Debts be paid out of my personal Estate.

Item. I Give and Bequeath unto my Loving wife Hannah after the above mentioned Debts and Expenses are paid and Satisfied and the above and within mentioned and bequeathed Legacies are Delivered[,] all the remainder of my personal Estate to her and he Heirs & assigns forever.

Item. I do hereby Constitute and Appoint my ?beloved wife Hannah to be Executor of this my Last will and Testament. In Testimony whereof ..{illegible] … things contained in this my Last Will and Testament I have hereunto Set my hand & affixed my Seal this Eleventh day of November in the year of Our Lord One Thousand Seven hundred and Forty Eight. --- James Pettyjohn [His Mark] In the presence of J??
