Biography

Dabney Phillips was born abt 1752 to Martin Phillips and Martha Hix, probably in Caroline County, Virginia. This was before the move of his parents from Amelia County, Virginia, to Mecklenburg County, Virginia. [1]. The land his father purchased is named in Dabney's Will. Dabney married Martha Hix about 1772, in Virginia, but the marriage has yet been located. She is named as Martha Phillips in the will of her father, Amos Hix[2]. Dabney and Martha had 6 children named in his will, Jane Phillips, Mary (Jeter), Archibald Phillips , Nancy Pettus Phillips, Dabney Phillips (Jr), and Martin Phillips. Nancy and Archibald had predeceased their father, leaving Dabney Phillips (Jr) as the eldest son. Dabney Phillips wrote his will in 1805, with a codicil in 1806 in Mecklenburg County, Virginia, which was entered for probate on 8 Nov 1806. The executors and sureties had to enter a bond in the amount of $15,000, though the inventory is difficult to read as well as the will due to tape in the digitilization. [3]

Transcription of will [5] In the name of God Amen, I Dabney Phillips of Mecklenburg County and State of Virginia, now in my perfect state Sences and sound mind and memory, do make and ordain this to be my last will and testament in manner and form following. Imprimis It is my desire that all of my estate both real and personal to be held in the possession of my beloved wife Martha until 10 Dec 1814 for support of herself and my and surviving children at her discretion and then to be divided in the following maner; Vis My wife to have the tract of land and one hundred pounds, and over and above that to have an equal part of all the rest of my estate with my surviving children. Item, it is my will and desire that if it should please God to remove my beloved wife Martha Phillips from this life, before the expiration of the above date, Eighteen Hundred and Fourteen, then in that case, the children that should be then living in a state of Selibacy (sic) should have the use of the house and plantation they shall marry and no longer. But should they shall not marry, it is my desire they should enjoy and have use of the house and plantation as their home at their discretion until the above mentioned date of Eighteen Hundred and Fourteen, and no longer. Whereas Archibald Phillips, beloved son, since departed, I desire the land I had let him be included in my estate, to the amount of 120 pounds and to be divided among his five children John, Archer, Dabney, Sarah Speed Dabney, and Martha Hix Dabney. Whereas it has pleased Almighty God to remove my daughter, Nancy Pettus Hill from my life, it is my desire that her husband, Richard Hill, or neither of their heirs should come in from any part of my estate that I have given her in a former will. But the child she left, Dabney Phillips Hill shall be raised and schooled on my estate at the direction of my executor hereafter named, and if he should live to the age of twenty years, I give to him a negro boy named Pen, or 100 pounds as my wife or executor thinks best, but if he should die before twenty years, his legacy be returned to the estate. It is my desire that Mary Jeter, Dabney Phillips, Jane Phillips, Martin Phillips, Elizabeth Hix Phillips , James Phillips, Pettus Phillips and Martha Holeman Phillips my children, shall have one equal part of my estate, both real and personal after the 10th day of December 1814, so as not to interfere with other devises herein contained. It is my will and desire that such a pat of my estate fall into the possession of my wife by this will be considered as only lent during her life and at her death may be equally divided among the children so named. It is my will and desire that at the death of my wife, Martha Phillips, the land I lent her be sold to the highest bidder on 2 year credit, and the money arising from arising be divided among my surviving children, but if she dies before 10 Dec 1814, then and in that case, my will and desire is the land house and Plantation be reserved as in former devise as a home for my such of my children as shall be & remain in a state of Selibacy (sic) until the 14tth of Dec 1814. It is my will and desire if any of my children shall die without lawful issue, that their part shall be divided among my surviving children. It is my will and desire that not any child of mine be entitled to any part of the above divisions mentioned, or in any wise alluded to until He or She renders a Just account of all that He or She hath received or may receive prior to any such divisions in order that each child may have an equal part of my Estate. Item it is my will and desire my tract of land lying and situated on Allen’s Creek in said County be considered under the same tenure as that on which I now live. Item it is my will and desire that my beloved wife, Martha Phillips as Execurtrix, my son Dabney Phillips and my son Martin Phillips and my good friend Allen Young be Executors so have this, my last will and Testament be recorded and fulfilled. In Witness whereof I have set my (Hand) and seal this twenty fifth day of November One Thousand Eight Hundred and five. Witnesses James Meacham, John Young, Polly Tanner, Pettus Phillips, Edward Holloway. Codicil to my will made this day 27th of June 1806, showeth that it is my will and desire that one Desk, six chests of drawers, and three dressing tables that I did lately employ Thomas Stone to make be disposed of in the following manner Viz that my son Dabney Phillips have the desk, and that my daughters, Jane Phillips, Elizabeth Hix Phillips,, and Martha Holeman Phillips have each of them on chest of drawers and one dressing table, and that my sons, Martin, James and Pettus Phillips have each of them one chest of drawers, to which I have set my hand and affixed my seal this day above mentioned and in the presence of witness Pettus Phillips, Archer Stone and Thomas Stone P 373 At a Court held for Mecklenburg County, the 8th day of November 1806, This will was proved on the oath of John Young, Pettus Phillips, and Edward Holloway witnesses thereto and codicil thereunder written was proved by the oaths of Pettus Phillips, Archer Stone and Thomas Stone witnesses thereunto and ordered to be recorded and on the motion of Martha Phillips and Dabney Phillips the executrix and exor therein named who made an oath together with Francis Hester, James Hester, John Rolfe, Pettus Phillips. Samuel Tanner and Tyrell Hutcheson their securities entered into and acknowledged their bond in the amount of fifteen Thousand Dollars, conditioned as the law directs Certificate was granted for them to obtain a probat (sic} therefore in due form, liberty being for them reserved for the other executives therein named to (Cin?) probat when he shall see fit.
