Biography

Edward Philpott was born about 1696 at William & Mary Parish, Charles County, Maryland[1] He was the eldest son of Edward Philpott and Susannah Posey.

Edward Philpott married Margaret Brayfield after 1707 (if Edward was at least age 21 when married), probably at Charles County, Maryland.

On 19 August 1718 (probate 28 October 1718), at Charles County, Edward was named an heir in the Will of his father, Edward Philpott. He and his heirs were bequeathed a parcel of land lying in Charles County (acreage not given), adjacent to 300 acres sold to his grandfather, Edward Philpott, by James Walker, and a negro girl named Esther (Liber 14, folio 672-674).[2] On 31 October 1718, Edward Phillpott as "nearest of kin" approved the Inventory of his father’s estate (Inventories 1717-1735, folios 52-56).[3]

On 13 May 1720 (probate 5 July 1720) at Charles County, Edward’s father-in-law, John Brayfield, mentioned Edward in his Will (Charles County Wills 1665-1767, folios 149-150): [4]

"I leave my Son John to Hudson Wathin untill he Comes to the age of 21 . . . and if Hudson Wathin dy I leave my son John to Edward Filpott . . . ."

Hudson Wathen was married to Mary Brayfield, the elder sister of Margaret.

  • 7 October 1720, Jno. Chunn, Edward Philpott, and John Craine witnessed deed in which Edward’s brother, Charles, leased land to John Fairfax.[5]
  • 20 April 1723, Edward Philpott and Samuel Love were sureties for the bond of John Philpott, Executor of James Cottrell (Liber 26, folio 144).[6]
  • 20 April 1723, John Philpott and Edward Philpott were sureties for the bond of Samuel Love, administrator of Lucia Dobson—alias Lucia Love (Liber 26, folio 144).[6]
  • 29 June 1724 Charles Philpott and Edward Philpott were sureties for the bond of Mary Hungerford, administrator of Thomas Hungerford (Liber 27, folio 66).[6]

On 22 January 1724/5, Edward’s sister, Eleanor Philpott wrote her will. She requested that her brothers John and Edward continue to remain with her son (also named Edward) until he reached the age of 21 years.[7]

Edward Philpott wrote his will shortly after, on 30 January 1724/5 (probate 27 January 1725/6) at Charles County, Maryland (Wills 1704-1733, Liber 3, folios 184-186).[8] An abstract of the Will follows:

  • I Edward Philpott being weak of body
  • to son John Phillpott, 2 cows and calves, and 3 heifers to be delivered when he arrives at the age of 16; and one sorrel horse and one young mare to be delivered when he arrives at the age of 20; and 4 yews and 4 lambs to be delivered when he arrives at the age of 21—John to be of age at 20 years
  • to son Edward Philpott, 2 cows and calves, and 3 heifers to be delivered when he arrives at the age of 16; a draft horse, one young mare, 4 ewes and 4 lambs to be delivered when he arrives at the age of 20—Edward to be of age at 20
  • to my two sons John and Edward Philpott, one negro woman named Esther with her increase to be equally divided between them when John arrives at the age of 20; also 100 acres of land called ‘’Court’s Palace’’
  • to my goddaughter Elizabeth Fairfax, one young ewe to be delivered the next fall after my decease
  • to my well beloved wife Margrett Philpott the tract of land whereon I now live during her natural life, then to be divided between my two sons; also all the rest of my goods and chattels

On 27 January 1725/6 (recorded 12 February 1725/6), at Charles County, the Will of Edward Philpot was presented, constituting Margaret Philpot Executrix, who was granted administration. The sureties were John Fairfax and Hudson Wathen (Liber 27, folio 243).[9]

On 25 February 1725 (recorder 16 March 1725), at Charles County, an Inventory for the estate of Edward Philpott (which included “1 Negro Woman aged about 17 years” [Esther]) was recorded. The appraisers were Richard Edelen and George Brett; the creditors were John Parnham and Gustavus Brown; the Executrix was not named; and the next-of-kin were listed as Charles Philpott and John Philpott (Charles County Inventories 1717-1735, folios 180-181).[10]
