Biography

Biographical Sketch Annie Powell was born Jun 23 1860, and died November 18, 1946. Annie never married perhaps due to the accident that left her blind at approximately 20 years of age. Having been to the movies and suffering eye strain she unfortunagely used a solution in her eyes to ease the discomfort and whatever it was left her blind. Annie lived most of her adult life with her sister Flora. She was very proud of her English heritage and preferred to consider that was her nationality; probably because her parents were both born in England. As a teenager I was asked to write letters for her as she dictated them; many were to family in England. A very sedate, quiet and seemingly proper personality. Her income came from owning rental properties and more probably her two brothers Robert and James took care of them for her. Obituary: Sacramento, California, The Sacramento Bee, Wednesday, November 20, 1946, page 22: "Vital statistics, Deaths: "POWELL - Entered into rest in this city November 18, 1946, Annie Powell, beloved sister of Mrs Florence M Harrison of Sacramento, Mrs S J Phelps of Los Angeles and the late Robert and James T Powell; a native of Wisconsin, aged 86 years. Friends are invited to attend the funeral Thursday at 1:30 p.m. from the Palm Chapel of James R Garlick, corner of Twentieth and P Street, where services will be held under the auspices of Rising Star Rebekah Lodge No 8, IOOF. Entombment East Lawn Mausoleum."

"Last Will and Testament of Annie Powell "I, Annie Powell, being of the age of seventy-eight years and of sound and disposing mind and not acting under duress, menace, fraud or undue influence of any person whomsoever, do hereby make, publish and declare this my last will and testament in the manner following, to-wit: "First: To the following named children of my deceased brother, John F Powell, I give and bequeath the following amounts as follows, to-wit: (a) To Walter J Powell, $300.00; (b) To John A Powell, $600.00; (c) To Mabel A Soman, nothing; (d) To Joseph Powell, $700.00; (e) To Bernard P Powell, $700.00. "It is my desire to benefit equally the foregoing five children of my deceased brother and it is by reason of the fact that I have previously given financial assistance to Mabel, Walter and John that they are herein bequeathed less than Joseph and Bernard. The amounts hitherto given to Mabel, Walter and John, taken in conjunction with the amounts of the foregoing legacies, will, I believe, substantially equalize matters among the five. "Second: My sister, Sarah J Phelps is now indebted to me upon a note for $3000.00 dated July 5, 1929 and secured by a trust deed executed by her recorded July 15, 1929 in Book 8206, page 207 of Official Records, Los Angeles County, California, and likewise upon an unsecured note for $2227.22 dated October 1, 1934. No part of the principal of either of said notes has ever been paid and the interest on each of them is considerably in arrears. It is my present intention to cancel said notes and release Sarah J Phelps from all liability thereunder; if, however, for any expressly direct that is not to be collected or enforced after my death, but on the contrary I instruct my executors to release the same and all security held thereunder and I direct that after my death my sister Sarah J Phelps shall not be required to pay said notes or any part thereof. By reason of the fact that said notes will be released without payment (either by me during my lifetime or by my executors after my death) and that my sister Sarah J Phelps will therefore benefit by being relieved from the indebtedness represented by said notes, I direct that my sister Sarah J Phelps shall not, nor shall any of her children receive any part of my estate. "Third: All of the rest, residue and remainder of my property I hereby give, devise and bequeath as follows: One-third thereof to my brother James T Powell; One-third thereof to my brother, Robert Powell; On-third thereof to my sister Florence M Harrison. "Fourth: I hereby revoke all former wills by me made and I hereby appoint as executors of my will my brothers James T Powell and Robert Powell, both to act without bond. "In witness whereof I have hereunto set my hand this 22nd day of October, 1938." "Notice is hereby given: that a petition for the probate of the will of Annie Powell, deceased, and for the issuance to Sarah J Phelps and Florence M Harrison of Letters of Administration with the Will annexed has been filed in this Court, and that the 9th day of December, A.D. 1946, at 10:00 o'clock A.M. of said day, at the Courtroom of Department No 2 of said Court in the City of Sacramento, County of Sacramento, State of California, has been set for the hearing of said petition, when and where any person interested may appear and contest the same, and show cause, if any they have, why said petition should not be granted.
