[3] JUDGE WARNS LITIGANT - Apology Tendered When a defendant in a civil action in the Supreme Court yesterday abruptly rose and started to walk out of the court, muttering: "It is no use staying here." Mr. Acting Justice Hart warned him that if he did not apologise he would be called upon to show cause why he should not be committed for contempt. He then adjourned the case, and on resumption after lunch the defendant, Glen Roy Auld Rea, of Brisbane, clerk, apologised through his counsel (Mr. Lukin). William Ernest Hargreaves. solicitor, of Ipswich, asked for an order directing that the defendant should join with him in selling Home Farm, near Ipswich, portion of the estate of the late Margaret Rea, of Thagoona, of which the plaintiff and defendant were co-trustees and co-executors. His Honour directed the sale of the property in question by tender, and ordered, by consent, that the defendant should have leave to tender. The further determination of the question whether the defendant should, or should not. be permitted to become the purchaser of the property was reserved, together with the question of costs, and the application was adjourned. Mr. J. S. Hutcheon (Instructed by Messrs. Nicol Robinson and Fox) appeared for the plaintiff, and Mr. L. G. Lukin (Instructed by Messrs. Morris, Fletcher, and Cross) for the defendant.
