Biography

Born 1657/58 in the Colony of Virginia. He married Elizabeth Trammell, sister of John Trammell who conveyed to him the land described below. Note: Something is very wrong here. Did the John Roberts from Wales marry Eliz Trammell or did this John Roberts? He passed away in 1724.

Land owner and planter of Overwharton Parish, Stafford Co., Virginia, in 1705 when he purchased for 4,700 pounds of tobacco a parcel of 100 acres from John Trammel on the south side of Potomac Creek. In 1718 he lived in what was then Essex Co., Virginia. He died in St. George's Parish, Spotsylvania Co., Virginia, in 1724 leaving five children viz: John, Margaret, George, Mary and Benjamin. Each of his three sons also had a son named Benjamin.

As new counties formed, the holdings which had been John's passed into Orange Co. in 1734 and into Culpeper Co. in 1748. He bought and sold several parcels of land between 1705 and 1724. Transcripts on file. His two older sons, John and George, were born prior to 1703 as they had reached their majority when his will was probated in 1724. The youngest, Benjamin, was born after 1703 (probably about 1707) as he was a minor subject to the appointment of a guardian under Virginia law when the will was probated.

Apparently, his wife, Elizabeth, had predeceased him as she is not mentioned in his will.

Earliest knowledge of John Roberts is found in Stafford [1], April 11, 1705, John Trammill (https://www.wikitree.com/wiki/Trammell-34) of Stafford sells to John Roberts of the same county 100 acres on the south side of Potomac Creek, part of a tract granted Francis Waddington now decd. and sold by his son Francis Waddington to the sd. Trammill.

On July 12, 1718, John Roberts of Overwharton Parish in Stafford County is granted two patents[2], one for 194 acres on the South side of Rappahannock River in the fork, in St. Mary's Parish in Essex County, beginning at the riverside at the upper end of an island, etc., the other for 100 acres "beginning on the north side of the mountain run." In 1721 the county changed to Spotsylvania and eventually to modern Orange County.

By May 12, 1722 [3] as John Roberts of St. George's Parish, Spotsylvania Co., he deeded this 100 acres on the mountain run as a gift to his son-in-law, Francis Kirtley. John was commonly referred to as John of Spots. [4] Feb. 10, 1723, DEED OF GIFT John of St. George's Parish, Spotsilvania Co., Va., to son-in-law, Francis Kerley, of St. George's Parish, Spotsilvania Co., dated May 14, 1722. Recorded Sept. 4, 1722: "100 acres on ye mountain run" - patented July 12, 1718. Witnesses: Augt. Smith, Daniel Huff, Abel Maylard.

Tyler's Quarterly Magazine p. 54 Collins. Francis Kirtley, apparently the immigrant, was born probably about 1690, and was married circa 1712. His wife was Margaret, daughter of John Roberts of Spotsylvania County, who died 1724.[5]

Spotsylvania Co., Virginia.[6] In the name of God Amen. I, John Roberts, of St. George Parish in the County of Spotsylvania ... First and principally I give my soul in to the hands of Almighty God nothing doubting but through the meritorious death of my Blessed Lord and Saviour I shall receive the same again at the General Resurrection and as for my body I recommend it to the earth to be buried in a Christian and decent like manner at the direction of my Executors hereafter mentioned and as for such worldly Estate as it hath pleased Almighty God to bless me with all;
I give and bequeath as follows, that after my debts and funeral charges being paid.
  • Imprimis: I give and bequeath unto my son Jno. Roberts all that tract of land laying up on the Flatt Run joyning to Hack Norman containing four hundred acres to him and his heirs forever.
  • Item: I give and bequeath unto my son, Benjamin Roberts all that tract of land laying on both sides the mountain Run joyning on Roger Abbots and Fields containing four hundred acres more or less to him and his heirs forever.
  • Item: I give and bequeath unto my son George Roberts my new Dweling Plantation with all the land adjoining to it with all the aprovements to him and his heirs forever.
  • Item: I further give unto my son Benjamin Roberts a young horse called Snip and my bridle and sadle and a young black mare colt that came of my old mare Ginney to him and his assignes forever.
  • Item: I further give unto my son George Roberts my old black mare Ginney and a young sorrell horse with a star in his forehead to him and his assignes forever.
  • Item: I give and bequeath unto my daughter Mary Paten Five Shillings currant cash to her and her assigns etc. Item: I give to my son John Roberts one fether bedd bolster pair blankets and one rugg.
  • Item: I give to my son Benjamin Roberts one fether bedd bolster pair blankets and one rugg. Item: I give and bequeath to my sons John Roberts, Benjamin Roberts and George Roberts all the residue of my Estate moveables and immoveables in what nature so ever to be equally divided to them.
  • Item: My will and pleasure is that my son-in-law Francis Kirtley and my son John Roberts be my full and sole Executors of this my last will and testament.
Revoking and making voyd all former wills by me made. In witness whereof I have hereunto set my hand and seal this 10th Day of September Anno Dom. 1724.
John Roberts At a Court held for Spotsylvania Co. on Tuesday the 3d day of November Anno Dom 1724. This will was proved in open Court by the oaths of Goodrich Lightfoot, John Brown and Matthew Bailey the evidences of said will and was likewise proved by the oath of Francis Kerkley Executor therin mentioned and is admitted to record. Research Notes:

Logically, Gainar (Pugh) Roberts cannot be John Davis Roberts III's biological mother, but his step mother. With John Davis Roberts II birth being in 1636, it can be surmised that he was married previously and his namesake being of this marriage. Gainar was therefore marked as non-biological, but may be changed with additional sourcing.

Roberts-23717 and Roberts-1635 appear to represent the same person because: Same death info. Husband of Elizabeth Trammell. There's uncertainty of his

birthplace (Wales? based on a "tree brothers story" that is probably false) and the birth date on both profiles is guess. c. 1670 in Virginia is a decent estimate. The Wales tale should be mentioned in the profile. See Vanice's book. I can document this after the merge. Steve Broyles

Find A Grave has a Captain John Roberts Jr. with the same death date and location.

It lists his parents as: father: John Roberts born 13 APR 1618 Rowley Regis, Staffordshire, England and died Jan 1689 Staffordshire, England / burial: 12 Jan 1689 St Giles, Rowley Regis, Staffordshire

mother: Alice / burial: 19 May 1662 St Giles, Rowley Regis, Staffordshire

It lists him as being born in Spotsylvania, Virginia 1654/1655 and Baptized 13 Jan 1655 Rowley Regis, Staffordshire, England.

Obviously, he was nor born in Virginia and then baptized in England. I have suggested a correction to Find A Grave: https://www.findagrave.com/memorial/172842949/john-roberts

Whether these are the correct parents I do not know.

He is not the son of John Davis Roberts and has been detached.

John Davis Roberts came from Wales in 1683 and settled in Pennsylvania. He married Gaynor/Gainor Hughes in 1684. They only had one son, whose name was Robert (See source below).

has his parents being from Rowley, Regis, Staffordshire, England but incorrectly lists him as being born in Spotsylvania, Virginia and Baptized 13 Jan 1655 Rowley Regis, Staffordshire, England. Obviously the baby was not transported back to England to be baptized. These parents lived and died in England. Whether they are the correct parents, I do not know.

Where's the proof that John was the son of John Roberts b ca 1606? Someone's family tree is not proof. Also, I've seen no proof that John, b 1658, was from Wales.
