—Ruddle's Troubles. rough-and-tumble on an oyster bed.
VERY CIVIL SERVANT AND-COMMISSION-CHASER FINED A FIVER EACH FOR ASSAULT. WORRY AT WELLINGTON POINT.
Frederick Massey, a Lands official, and William Alfred Dabbs, a commission agent, residing at Wellington Point, were proceeded against in the South Brisbane Summons Court on Monday, April 19, before Magistrate Pears, for unlawfully assaulting Roland Arthur Ruddle on April 2.
Mr. T. J. O'Shea prosecuted, Mr. J. B. Price defending.
Roland Arthur Ruddle, a photographer, said that about 4 p.m. on April 2 he was crabbing on the beach at Wellington Point, in company with others. While bending down, he noticed defendants coming towards him. DAbbs was the first, to reach him, and a conversation ensued, Dabbs using some strong language, after which, he hit witness ON THE JAW. Witness did not know he was trespassing until spoken to and informed Dabbs that his name was Ruddle if he desired to take action. Massey then came up and attempted to hit witness with a baton, which was warded off, Massey then striking the complainant with his fist.
Cross-examined by Mr. Price, witness said that Dabbs never pointed out the notices. Witness never made a swing at anyone with his hook. James Charles Morehead Wilson, a lad of 13 summers, said he was with complainant on the 2nd instant. he saw the defendants come along the beach, Massey afterwards striking witness. He also saw Dabbs hit complainant, but did not see Massey do likewise, as he ran away.
Alton Charles Edward Evans, an engine-fitter, residing at Breakfast Creek, gave a version of the assault along lines similar to that of the complainant's story.
Colin Ruddle McMurray, a 12-year-old lad, also gave a version of the occurrence agreeing with the statements of previous witness.
William Alfred Dabbs said that on the unlucky day he was sitting on his veranda when he saw five people ON HIS OYSTER BANK. He went down, meeting Massey on the way. Arriving at the edge, he sang out, "Come off that bank". No notice being taken of the request, he went over to the trespassers and asked what they were doing, receiving a reply from complainant that his name was Ruddle. Witness asked him did that justify him trespassing, receiving a reply that complainant didn't care about that, at the same time making a bang at witness with his crab-hook. Witness caught the hook, and attempted to wrest it from Ruddle. Looking around, he saw Wilson bolting with a bag. and intended chasing him. Realising that Wilson was beyond reach, he went back. Witness then saw Ruddle strike Massey with the hook.
To Mr. O'Shea: Complainant was not assaulted on the beach that day to the knowledge of witness. There was blood on his nose but it could have been caused by his tripping on the rocks and falling. Massey said something to him about striking Ruddle in self-defence.
Frederick Ernest Massey said that he went on to the bank in company with Dabbs. Wilson passed witness with a bag; and witness attempted to knock it from his shoulder with a stick, doing nothing further. Witness then saw Ruddle attempt to hit Dabbs with a hook, so he went over. Complainant swung at witness who however, countered the blow and GOT IN FIRST. That was the only blow he struck.
Cross-examined by Mr. O'Shea, witness, stated that he thought Wilson was lying when he said witness struck him on the leg. The reason for striking him was to obtain possession of the bag.
Colin McMurray was recalled, and said he heard Massey give his evidence. At the time Massey struck Wilson witness was carrying the bag, and he had been doing so all the time they were on the bank.
The magistrate found the charge proved, and fined each of the defendants £5: including costs, in default one month.
