1938 Winder, Barrow, Georgia:

Richard Brevard Russell died, age 77. His body lay in state the next day in the capitol rotunda in Atlanta, with a military guard of honor. His funeral was at First Baptist Church in Winder and he was buried in the family plot in Winder.[9]

Senator Richard Russell of Georgia boarded the Havana Special here early this morning to rush home to his family where his father, Chief Justice Richard Brevard Russell of the Georgia Supreme Court, died Saturday at Winder, Ga. Senator Russell was a member of the Washington party touring Florida and rushed here by auto to board the Florida East Coast train, held here after its arrival for the Senator, according to Floyd B. May, district passenger agent of the FEC. The train was held here about one hour. Senator Russell told Mr. May that the car bringing him from Miami was in an accident and turned over. The Senator said his left knee was hurt somewhat. A passerby whose name was not learned rushed him to the train being held here. WINDER, Ga., Dec 3 (AP) -- Chief Justice Richard Brevard Russell of the Georgia Supreme Court died tonight at his home at Russell, Ga., near here. He was 77 years old. The chief justice is father of United States Senator Richard B. Russell, Jr. Robert Russell, another son, said his father died quietly in his bed after returning home from Atlanta, where he had worked for several hours in his office at the State capitol. The chief justice's wife was in the bedroom with the jurist when he died at about 8:30 p.m. Robert Russell said his father had complained of a slight pain in his chest before going to bed. The had apparently subsided, he said, and the chief justice and Mrs. Russell had been talking when Mr. Russell "dropped off to sleep." The younger Russell said he had come over from his home adjoining the chief justices to speak to his father. He walked into the room and noticed his father was not breathing. Mrs. Russell, he said, did not know until then that her husband was dead. Dr. W.L. Matthews, Winder, was immediately summoned. He said the chief justice died from a heart ailment. "His heart just quit, apparently from a worn-out condition," Dr. Matthews said. He attributed death to the infirmities of age. William J. Russell, another of the 13 Russell children, was present in the home. Mr. Russell, a tall wiry man for his years, had served as the State's chief justice since 1923. He came to the bench with a distinguished record on the Georgia court of appeals, of which he was chief judge from 1913 to 1916. His political career began in 1882, when he was elected Clarke County's Representative in the State Legislature, after graduation from the University of Georgia. He served three terms in the assembly and then was elected solicitor general of the Superior Court. In 1891 he was elected judge of the circuit. While judge of the superior court, Mr. Russell entered a four-cornered race for governor. He was second in the field. The following year he was successful in a race for the court of appeals. A previous attempt to reach the court, in 1904, had been unsuccessful. The chief justice also had been thwarted in an ambition to be United States senator when he was defeated in 1926 by Walter F. George for the post formerly held by the late Thomas E. Watson. He later had the great satisfaction of seeing his ambitions to be both governor of Georgia and the state's senator fulfilled by his son.

A military guard of honor was set in the capitol rotunda where the body of the 77-year-old jurist will lie in state until 3 p.m. As state officials, members of the bar and plain citizens lauded the chief justice, Governor Rivers announced the capitol offices would be closed from 10am to 3 pm today in the jurist's honor. Funeral services are to be held Tuesday at Winder at 11am at the First Baptist church. Interment will be in a family plot in Winder.
