Peter Theodore Schumacher was born 3 Feb 1816 in Hamburg, Germany. He was the son of Adolph Heinrich Wilhelm Schumacher and Johanna Ilsabe Marquardt. He emigrated to South Australia on the George Washington, arriving 2 Mar 1849. [1]
Peter Theodore Schumacher and Augusta Hakendorf were not married. They had children : Theresa (c1851), Adolphus Heinrich Wilhelm (1853), Emilie Christine (1855) and Theodor William (1859).
He married Paulina Homburg 24 Oct 1860 at St Luke Church in Adelaide.[2]
He passed away age 49 on 7 Oct 1865 in Adelaide [3] and was buried in West Terrace Cemetery. [4]
On the 4th October 1860 Peter Theodore Schumacher made a legal settlement with Augusta Hakendorf, whereby she was forbidden to live in any part of South Adelaide, or to visit his home or his place of business or to injure or annoy him or any person living with him or employed by him. Of the children Theresa and Adolphus were to remain in the custody of their father while Emilie was to remain with her mother until she was 10 years old or her mother remarried. In return Theodore promised to pay her £2 a week while Emilie was with her and £1 pound for life thereafter, and to buy a house and lease it to Augusta for a peppercorn rent for her natural life, provided that she continued to reside there.
After the death of Peter, his entire estate was left to his wife Caroline. His eldest daughter Theresa had died from diptheria while living with her father, and Adolphus now had to return to live with his mother, with no provision for his upkeep.
Emilie had reached the age of 10 but because of her fathers illness, she remained with her mother.
Payment of Augusta's allowance was cut after the death of Peter, and in December 1865 Augusta lodged a bill of complaint against Caroline in the Supreme Court.
The Supreme Court upheld Augusta's claim granting her £500 in lieu of the conveyance of certain lands to be set apart by the deceased, P.T. Schumacher, for the use of the plaintiff and her two children.
But the matter came before the Supreme Court again in 1868 as neither the amount or interest had been paid.
It was stated that Augusta had priority over other creditors, but as the land had been unable to be sold, there was no means of enforcing the first decree.
The judge declined to make the decree asked for, on the grounds that the decree in the original suit was erroneous. He pointed out that the suit was brought upon an agreement between Peter Theodore Schumacher and the plaintiff (Augusta), with whom he had been cohabiting. He considered that the agreement was not one which a Court ought to enforce performance of.
