According to some information that was sent to me by a cousin, Cornelius Smith was born January 11 1811 in Cork,Ireland. There was chaos and unrest between England and Ireland. When Cornelius was twenty-two years of age, he and eleven friends purchased a schooner and set sail for America. After a rough and stormy voyage, they landed on the coast of Florida. Cornelius made his way to Illinois to the home of his aunt and uncle, Tom and Nancy Lincoln. Tom Lincoln found Cornelius a job teaching in Alabama. This is how he met and married Sarah Pate. In 1856, Cornelius took his family to Texas. Three of Sarah's sisters and their families took on the long trip to Texas. They started the long trek to Texas.

Bolling Judge of Probate July the 20th 1853 ) Whereas it appears to the satisfaction of the court that heretofore that James E Hathhorn had been duly appointed guardian for Sarah Pate and that he had given bondand security in the total? sum of Four Hundred Dollars payable and conditioned as required by law; Which bond was approved of and recorded in the office; and it further appearing to the satisfaction of the court that all the records, books, papers & c belongings to this office were destroyed by fire on the night of the 12th day of April1853, as the Court House of said county, and it further appearing that by said fire that all of the papers in this case were destroyed, and it further appearing to the satisfaction ofthe court that said James E Hathhorn has since removed his said appointment as guardian as aforesaid has removed from the State of Alabama, __ It is now thereforeordered by the court that said Theophilus Daniel be and he is hereby appoint James E Hathhorn be discharged and he is hereby removed from the Guardianship of said minor, and that Theophilus Daniel be and he is hereby appointed Guardian for said Sarah Pate minor heir of Abemick Pate decíd and that he be not required to give bond and security for the reason that he has the money ready in Court to pay over to his said ward, & This day came Theophilus Daniel Guardian for Sarah Pate minor heir of Abemick Patedecíd (by his attorney S J Bolling) and filed his account for Final Settlement with his saidward, and also appeared Cornelius Smith the husband of said Sarah, and it appearingto the satisfaction of the Court that said Sarah Pate has united married with said Cornelius Smith; and it further appearing that said Sarah has arrived at full age andover, and by consent of parties the notice required by law is waived and all other irregularities, and the parties consent that the court shall make up the account between them; Whereupon the Court proceeded to state the account current between the parties, wherby it appears that said Guar- dian is chargeable to the amount of one one hundreed and ninety five & 78/100 Dollars for so much of the estate of his said ward having come into his hands for which he is chargeable and that said Guardian is entitled to credits to the amount of Ten & 85/100 Dollars for money paid out and andintended for the use and benefit and on account of his said ward leaving a balance due from said Guardian to his said ward of one hundred and Eighty four & 93/100 Dollars on this settlement, It is therefore ordered and decreed by the Court that said Cornelius Smith and his wife Sarah Smith recover of said Theophilus Daniel Guardian as aforesaid the said sum of one hundred and eighty four & 93/100 Dollars for the sole and separate use of the saidSarah Smith, that being the amount as obtained to be due them on this settelement, butbecause the said sum of one hundred and eighty for & 93/100 Dollars is paid over to the said Cornelius Smith in presence of the court and the receipt filed therefore, thereforeno consideration? is to issue on this decree. It is further ordered that the account current made up be recorded and filed in office together with the receipt, and that said Theophilus Daniel be from thence discharged from any further liabilities as Guardian as aforesaid...
