Halifax County, Virginia Will Book O, page 179: In the Name of God Amen I John Smith being Sick and weak do make and Constitute this my last will and Testament in manner following (Viz.) Item I give to my Son William Smith a negro man named Sammy, Item I do give to my Son John Smith wench named Roje(?), Item I do give to my son Thomas Smith a negro wench named Jeane, Item I give to my son George Smith a negrowench Lucey, Item I do give to Daughter Rachel Seay a negro Boy named little Sammy, Item I do give to my Daughter Anne Suallin a negro Boy named Peter, Item I do give to my Daughter W. Cary Thimbr--- a negr ogirl named Bep for her lifetime and after death to her daughter Hannah Thimbrew. Item I do give to my daughter Margarett Mopley a negro boy named Lewis. Item I do give to my daughter Sarah Lewis a Debtof L 30, 16, due to the Estate. Item I do give to my Daughter Anne Saullin one hundred Acres of Land it being my Plantation. Item I do give to my Grandson John Seay all the remaining part of my land for Paying of Ten or Twelve pounds all to Continue together for this year and I also do appoint and give to my beloved Wife Margaret two Negroes for her life time namely Tommy and Bep the same Bepis to be given to who her Miltrep (Mistress) pleases her at her death. I do appoint Jacob Seay and Bury Lewis Executors to this my last Will and Testament as Witnep my hand this twenty Sixth day of February 1764. (signed) John (X) Smith (His Mark)

At a Court held for Halifax County the 17th day of May 1764
This Will was proved by the oath of Joel Hill and Moses Seay the witnepes hereto subscribed and ordered to be Recorded, and Jacob Seay and Bury Lewis the Executors herein named refusing to take upon them the Execution hereof Certificate for obtaining Administration of the Estate of the Testator with the will annexed was granted to John Smith who made oath according ----- he having with Jacob Seay, Jesssee Suallin and Thomas Smith his Securities entered into and acknowledged Bond for the same By the Court. I've seen the clerk's copy of this will as recorded in Halifax Co., VA, WB O, p. 79. It's extremely difficult to read. Marian Dodson Chiarito abstracted John Smith's will in her book, "Will Book O, 1752-1773, Halifax County, Virginia," ® 1982 by Marian Dodson Chiarito; reprinted, Iberian Publishing Co., Athens, GA, 1995. She gives the legatees as: wife Margaret, sons - William, John, Thomas, George; daughters - Rachel Seay, Anne Luallin, Mary Kimbrew, Margaret Mosley, Sarah Lewis; granddaughter Hannah Kimbrew, grandson John Seay; Exrs - Jacob Seay, Berry Lewis; s/ John Smith [his mark is an S with a diagonal slash through it]
