He was the son of Sir Edward Smyth, 3rd Bt. and Anne Hedges.
Sir Charles Smyth, 5th Bt. was baptised on 12 October 1711 at St. James' Church, Westminster, London, England.
He succeeded as the 5th Baronet Smith, of Hill Hall, co. Essex [E., 1661] on 4 March 1760.
He married Elizabeth Burgess, daughter of John Burgess, on 11 August 1760.
He held the office of High Sheriff of Essex from 1760 to 1761.
He died on 24 March 1773 at age 61, without male issue. His will was proven (by probate) on 3 April 1773. His last will was dated 24 May 1769.
He was buried on 1 April 1773 at Theydon Mount, Essex, England
