Although this looks suspiciously like Benjamin Soule, son of George and Lydia, the General Society of Mayflower Descendents has allowed that this Benjamin exists. Do not merge with Soule-29.

Birth

Benjamin Soule was born in 1728,[1][2][3][4] son of Joseph Soule a mariner who died while Benjamin was still young, leaving him to the care of family members.[3]

He was probably born in Dartmouth, Nantucket, or North Carolina about 1728.[4][3]

Marriage

The latest from the Mayflower Society says Benjamin married Elizabeth Davis[4] This is based on the entry in the Bible of Jonathan Wooster, in which he states: (My great-great-great-grandparents.) ... Benjamin Soule, 1728. Elizabeth Davis, Jan 21, 1730. [1] which is a logical conclusion given the information.

From the Beekman Patent, Benjamin m. Elizabeth _____, who m. 2nd Jeremiah Davis.[3]

Jeremiah Davis made his will 19 1m 1800 and proved 4 June 1807, Coeymans, New York. He named his wife Elibeth (who gets the furniture she brought); sons Ezekiel, Jedediah, and William Davis; and daughters: Massy, Leddy, Mary, Nancy and Elizabet; brother Uriah Davis.[3]
Elizabeth Davis, of Coeymans, New York, made her will 1st of 2nd month 1812 which was proved 26 Aug. 1813. She names son George Soales, son Jonathan, eldest son Ebenezer; 5 daughters:

Rebecah, Ruth, Martha, Elizabeth, and Margret; son George Soule and Caleb Tompkins named executors. Witnesses were John W. Widbeck, Jeremiah Williams, and George Mosher.[3]

Son George is linked to Hannah and Anna Soule, in a joint deed 1808, naming all three[3]
Brothers Jonathan, George and Isaac may have removed to Duanesburg, New York, together, "although Isaac is probably son of Jonathan."[3]
It seems the creator of the Bible entry knew Elizabeth later in life by her married name, Davis[3]

Death

No positive death date or place is known. He was perhaps the Capt. Soal who died of a consumption in Plainfield, Connecticut, about March 1779.[4][3] Note: Plainfield, Connecticut is not close to Dutchess County. He was still alive in 1777, and was dead before 1800 (date of Jeremiah Davis' will.)


Suits:

21 May 1751 Bartholomew Noxon sued Benjamin Soule in Dutchess County Court of Common Pleas. Benjamin was indicted in the Court of General Sessions 15 Oct. 1751.[3]
Aug. 1759. Benjamin Soule sued Ephraim Harris in the local Court of Common Pleas and was awarded £8.[3]
Oct. 1762 Aurye Buys sued Benjamin Soule in the same court.[3]

“Serjeant Warner produces the report of a Guard of Capt Kelseys Comp consisting of 8 men, amount to £1..4.. for last night’s service.” “Hezekiah Mills being duly Sworn, deposeth & saith, That lately he assisted Serjt Nucomb of Capt Saml Smith’s Comp to drive some cattle that had been Destrained for Fines, that the same evening the Dept [deponent] saw Benj Soles who asked him if he had assisted in driving the cattle to which the Dept replied that he had, whereupon Soles said that he would take Notice of it, or words to that Effect. And the Dept further saith, that Soles appeared to be somewhat in Liquor.”

“Benjamn Soles being previously apprehended Ordered that he be committed to Goal”
The Committee ordered Benjamin Soles discharged at the meeting held Thursday 15 May 1777.[5]
19 July 1777 (the same committee) were informed that several "persons lately set out in order to go to the Enemy, but being discouraged, returned back, that their intentions however, were only to wait till the Enemy Advanced farther into the Country, & then go off. That the Dept [deponent] thinks that Sissel said, some of the above persons who were thus to go off, were of the name of Sole."[5]

Leut. Howlin Soles, George Soles, Jonathan Soles, Daniel Soles and others were apprehended by the militia on their way to join the British Army on the 1st Jan 1777.[5]

  1. Joseph, b. c, 1749; died after 1 Aug 1776, when he enlisted in a Minute Man Muster, Capt. William Pearce’s company. Joseph was age 25, 6’ tall, with a pale complexion with light hair and light eyes at the time. He was born in Dutchess County.[3] From MFIP: Joseph ?? c. 1751 Dutchess Co. NY[4]
  2. Howland "b. ca. 1751; m. Eunice b. 19 April 1760, dau. of Jonathan and Mary (Soper) Lapham. Howlin Soule was one of the men sent to work on obstructing the Hudson River in Feb. 1777. On 4 April 1777, William Busby testified “that some who had taken the oath of allegiance to this state were now absent again, among whom were Benjamin Booth and Howland Soles.” Private (sic) Howland Soule was noted as dec’d 4 Aug. 1777 in Capt. See my comment on the other Benjamin Soule b. 1728. The first cousins were confounded many years ago. It has taken years of research and several publications to separate the two. The two families of children were also confounded. A y-DNA "flag" helps to separate the sons of the two families.

There is a Y-DNA "flag" in male-lineage descendants which separates this branch of the family from other descending branches.
