Will of Adam Wemmer
- In the Name of God amen, this seventh day of March one thousand eight hundred and twenty three, I Adam Wemmer of Providence township, Bedford County and Commonwealth of Pennsylvania, being weak in body but of sound memory, mind and understanding, thanks be to God for his mercy, and calling to mind the mortality of my body and knowing that it is appointed for all men once to die, make and ordain this to be my last will and testament.
- The premises where I give and bequeath in the following manner that is to say principally
- First of all, I give my soul into the hands of the almighty God that first gave it me and as for my body I recommend it to the earth to be buried in a decent christian like manner at the discretion of my executors , and as for such worldly goods as it has pleased God to bless me with in this world, I give and bequeath To wit;
- First, it is my will that all my just debts and funeral expenses be paid as soon as can be after my decease. I give to my well beloved wife Susannah, the full possess of the house I now live in during her widowhood, to be at her disposal. I likewise give to her one feather bed and bedding, and bedstead of her own choosing to her, her heirs and assigns forever, to be at their full disposal. I also give her one falling leaf table chest, one tea kettle, one iron pot, frying pan and dutch oven with half the delftware and half the pewter, one woman saddle, two cows, six sheep, two hogs, one and fifty dollars in money , all to be hers, her heirs and assigns forever. I also give her the one sixth part of all the grain and hay raised on the place during her widowhood, with one half the room in the garden
- I give to my son Joseph, that track of land on which he now lives I have bought it and payed for it and the conveyance has already been made to him, his heirs and assigns forever
- I give to my son Abraham, one hundred and seventy two acres of land adjoining the land of his brother Joseph, out of a warrant of, three hundred and some odd acres , taken out in the name of Abraham Wemmer to him, his heirs and assigns forever.
- I give to my son Jacob, one hundred and fifty acres, already marked out to him and on which he now lives, to him, his heirs and assigns forever
- I give to my son John, the remainder of the track of land, I gave to Abraham, and Abraham is to make a clear conveyance to John out of the above named warrant for John part, the division line being already marked out and he must do it without fee or reward, I having paid the charges already, I also give him another piece of land that I hold by improvement, it lies south from the house I live in, I give both these to John his heirs, and assigns forever
- I give to my son James, one hundred and fifty acres, adjoining the land I gave to his brother Jacob, the division line being already marked out and which he now holds in possession
- I give to my son Solomon, two hundred acres of land being track I live on, with all the appurtenances thereto belonging to be his heirs, and assigns forever, I also give him one feather bed, and bedding, and bedstead, one wagon and all the harness to it belonging, one wind mill all the Joiner tools, all the cider barrels, the irons, and six chairs, all to be his, his heirs and assigns forever. I also give him one grey mare, two cows, six sheep, this be his forever,
- I also give to my son Abraham, one feather bed and bedding and bedstead to him his heirs , forever.
- And as for the rest of my property that is not willed nor bequeathed, it is my will that it shall be put to sale by my executors, and the money to be divided among my five oldest children equally, and I do appoint and institute my son Solomon and James Sparks senior, to be the Executors of this, my last will and testament
- And I do hereby and disannul and declare void all former wills by me made or said to be made fully ratifying this to be, my last will and testament,

- In Witness thereof I have hereunto set my hand and seal the day and year above written, sign sealed Published and declare by the testator as his last will and testament in the presence of us who at the Request of the testator and in presence of each other Subscribed our Names as witnesses.

- Personally appeared before the subscribed register for the probate of wills and granting Letters of administration in and for said county, Daniel Means and Amos McDaniel, the subscribing witnesses to the foregoing instrument of writing who being duly sworn do depose and say that they were personally present and heard and saw the testator, Adam Wimmer sign by making his mark seal and declare the foregoing instrument of writing as his last will and testament and that they saw the Testator sign the codicil thereto attached and acknowledge the same as a part of his last will and testament, that at the time of signing the aforesaid instrument of writing and the codicil thereto annexed, the testator was of sound and disposing mind memory and understanding, according to the best of these deponents knowledge and belief, that they subscribed their names to the foregoing instrument of writing and codicil thereto annexed in the presence of the testator and at his request.
