Deed

This Indenture made the first day of January in the year of our Lord eight hundred and thirty nine, between Nathaniel Deputy of Cedar Creek Hundred, Sussex County and State of Delaware of the one part and Daniel Deputy of the Hundred, County, and State aforesaid of the other part
Witnesseth whereas James Deputy, late of Sussex County and State aforesaid was in his lifetime and at the time of his death, seized of as in fee of a certain tract of land and marsh in the Hundred, County and State aforesaid (in Slaughter Neck) and left to survive him, six children equal heirs to the tract of lands and marsh aforesaid viz: John R Deputy, Mary Deputy, who has since married Manlove Davis, Daniel Deputy, one of the parties to this Indenture, Nathaniel Deputy, the other party to this Indenture, Elizabeth Deputy, now the wife of Elias Bennett and Sarah Deputy, each of the above named heirs being entitled at the decease of their father, James Deputy, aforesaid, to one share or one sixth part of the land and marsh aforesaid.
Now this Indenture further witnesseth, that the said Nathaniel Deputy, for and in consideration of the sum of four hundred dollars lawful money of the United States of America, to him in hand paid by the said Daniel Deputy before the sealing and delivery of these presents, the receipt whereof the said Nathaniel Deputy do hereby acknowledge said receipt herewith fully satisfied, content and paid and do hereby acquit, exonerate and discharge the said Daniel Deputy from every part and parcel thereof, have granted, bargained, sold, aliened, enfeoffed, conveyed and confirmed and by these presents do, grant, bargain, sell, alien, enfeoff, convey and confirm unto the said Daniel Deputy, his heirs and assigns forever, all rights, title, claim, interest, demand and estate of, in, to and out of all the land and marshes that were late of James Deputy, deceased, that is now have or hereafter to all the lands and marsh aforesaid situate lying and being in Slaughter Neck, Hundred, County and State aforesaid adjoining lands of George Bennett, John G Levitt, the heirs of John Wilson and others, containing two hundred acres of land and marsh be the same more or less together with all and singular, the houses, barns, stables and gardens, fences, orchards, woods and underwoods, water and water courses, hereditaments and appurtenances unto the same belonging or in any wise appertaining, to have and to hold all the above described mentioned or intended so to be share of land and marsh above recited with all the premises thereunto belonging to the only proper use benefit and behoof of said Daniel Deputy, his heirs and assigns forever clear and free from all incumberances
And the said Nathaniel Deputy, for himself and heirs, executors, administrators, covenant, grant and agree to and with the said Daniel Deputy, his heirs and assigns all the above recited share of land and marsh and premises from all person or persons now lawfully claiming hereof to claim the same or any part thereof will warrant and forever defend by these presents

Be it remembered that on the first day of January in the year of our Lord one thousand eight hundred and thirty nine personally appeared Nathaniel Deputy before me, a Notary Public of the State and County aforesaid and a party to said Indenture, to be his act and deed respectively and desired that it might be record of testimony, Whereof I have hereunto affixed my hand and seal the day and year above written.
